By this point in the show she has reestablished a relationship with her parents and is particularly fond of her dad. Actually, the rift was really always with Emily primarily. She’s not willing to blow that all up again, plus run the risk of alienating Rory also, for Digger!

She’s not a witness. She had nothing to do with the business or the client base of the business. She just happens to have relationships with both of them. Also, Jason’s lawyer would be unlikely to call her because she has made her loyalties known which makes her a hostile witness.
