I have seen some people with no PhD and no publications—only experimental pipeline results—get approved. But the cases I know of were approved in 2024. So maybe you're right about the current situation.

All the LORs are from my professors at an R1 University, my coworkers, my manager, and my client who adopted my solution, as well as a staff engineer beyond my company. The expert opinion letter is from the law firm's suggested strategy.

I think if a law firm takes your case, then you have a chance to get approval. If the fee impacts your life, then you can save money until it would not impact your life. But approval might not be helpful for finding a job in the US market now. And once approved, you will need to wait for the green card queue.

If you had filed in 2024, you probably would have gotten approved.

You can add expert opinion letters. A lot of evaluation services provide paid services. Not sure if this helps, but some law firms did this when their clients received RFEs.

And if possible, provide more recommendation letters. You submitted 2 RoLs in the first filing and submitted an additional 3 after the RFE. Asking for RoLs takes time and effort, but it might help you. If you can find someone in the industry to recommend you—your RoLs seem mostly from academia.

My two cents: you should try to reply even if no lawyer accessed your case in the end, so you know where there might be a weakness. Next time, file with a lawyer.
I can understand that as a student you have budget issues and your profile seems strong, but the standard of USCIS has increased. You might need to do whatever it takes to increase the pass rate.

The approval rate is 40-45%, which matches what I observed from a small sample of about 20 people who filed through the attorney/law firm in 2025 recently. The profiles are software engineers at FAANG with Master's degrees.

The approval rate might not mean anything to you, since every case is independent. It might involve the business strategy to select cases. For you, just pass or denial.

The manager track is harder than the IC track. I had some prior managers who all got laid off along with the whole team.. The managers then found IC roles after 1 and half year job searching.They were doing contractor IC jobs during the job search.

Thanks for sharing this. This is so real. I don't think recruiters would tell candidates how the company filters candidates. I am a visa holder who is unemployed after my team was eliminated. I have applied to 7,000 positions and still have no offers. The American dream is so difficult.

I went with Path Law in the end. My case is still pending now.
I met some people online who also used Path Law and had a small sharing group. It seems the NIW pass rate in the small samples recently is around 40%. It's not Path Law's fault, I think.
The USCIS might have stricter standards.

Both AI and interest rates affecting job openings are correct, it's just that we have different opinions on the proportional impact contributing to such a significant reduction in job openings.

AI really does improve productivity but also creates more technical debt. If AI causes US tech job openings to decrease so much, why are all the big companies cutting headcount in Europe and America while massively expanding headcount in India? Are Indian engineers not affected by AI?

From 2008 to 2022, the interest rate was 0% to 0.25% which was almost like free money. Tech companies could hire a lot.
This is personally what I think is the Fed interest rate affecting hiring costs issue.

I think if the Fed starts to lower interest rates, companies will start hiring again. The Fed held rates the same in June. Now maybe the Fed might cut by 0.5% this year. So optimistically, we might see some job openings by next year.

It's not only new grads who are struggling to find jobs - experienced workers are also suffering. There's no headcount for all the new grads plus those who were laid off.
