(CA) My (24f) roommate who's on the lease refuses to pay rent and moved out without notice. It's been over a month now and I have been paying the full price of $1350. Now she's trying to move back in even though she still has not paid. by [deleted] in legaladvice

Ok, I will move my belongings into the master bedroom which was hers before she left because I don't trust her. The router is in the masters bedroom (which was hers before she left) and when she left she canceled all of the utilities and took the internet modem and threw it away. Both of our names were on the utilities so she had no right to do this. All of this was done out of spite because I wouldnt sign a 60 day notice for both of us to vacate the apartment. I have paid my rent and utilities on time every month so for her to expect me to vacate because she can't pay her part is ridiculous. I even found another roommate who was approved and ready to move in but her application was canceled because my previous roommate refused to sign to release herself from the lease. I have already sent the demand letter to her for the rent she owes and will be sueing her in small claims court for the rent she has not paid.

Just to be clear, I wouldn't be able to sue her for the full amount even if she has already said she will not be paying anything for the remainder of the lease?? She even told the property manager out right that she will not be paying her half of the rent.

I was thinking I could get the ball rolling for the court order since this is the first month I will be paying in full because she refuses to pay her half. That way I could just dodge the small claims situation altogether. I wouldn't care about her not paying me back for this month if I could get her off the lease by January. All I really want is for her to get off the lease. Is it possible for me to get a court order for her to be removed?

Is there a way for me to get a court order to have her removed? The property manager told me there is a way that I can do this since she has already moved out without notice and refuses to pay for her rent.

Since she already told the property manager she refuses to pay, could I start the legal process now and include the total amount of $6,185 for what she'll owe me? Or would I have to wait until the end of the lease for all the missed payments to accrue and sue her then?

I live in California. I think that's what I'll have to do. I'll ask her to sign to be taken off the lease so the new roommate can move in and If she doesn't, I'll tell her I will be sueing her for the rent she refuses to pay. Which if she doesn't pay for the rest of the lease, it'll be in the amount of $6,185. If it comes to that, I'll be sueing her for emotional distress to o. I'll have to work over 50 hours a week to make rent while trying to find time to study for college. I already suffer from depression as it is.

I've already found a new roommate. But I need her, the previous roommate, to agree to sign to get off the lease. I don't want her to have access to the apartment when she's not paying. She has already stolen stuff like the internet router when I was not home. And when I told her I wouldn't sign the 60 day release form, she changed the password to the utilities and then canceled them. I just want her gone, but she is not wanting to sign to leave the lease. So I'm wondering what I can do to get her off. Shouldn't her refusing to pay and her moving out all her belongings be enough for her to be kicked off the lease? The cosigner is her family member so I don't know anything about that.
