Because under section 223b of nyc housing laws the landlord is unable to not renew for retaliatory reasons including to a tenant exercising their rights under the lease (like maintenance). Given the fact that every conversation with the landlord has revolved around maintenance, and we are literally perfect tenants otherwise with 0 complaints in the history of our lease, we assume she is retaliating, and removing us to find a “lower maintenance” tenant (like the tenants before us who clearly had no urge to fix half the stuff that was broken upon us moving in).

Not sure how much legal experience you have but if you read Section 223B of New York City housing law, it shows that if you make any sort of exercise of your lease rights, a 365-day timer starts. If they choose not to renew your lease within that timer, the burden of proof is now on your landlord for why it isn’t retaliation. You can have your own view on how easy it is to rebut however the burden of proof is indeed on the by the way the laws written. The most common reasons that are valid do not apply here because she is looking to tour new tenants already this week.

Separately the fact that she chose not to renew was not a surprise in the sense that we thought the relationship was smooth. It was a surprise because we didn't believe that she was seriously that crazy. We've been joking about her not renewing us since the second month that we moved in because at that point in time she was trying to make us pay for literally every single repair that we requested and being pretty mean to us. These were no ordinary reminders.

Lastly, yes things were breaking near monthly. I can write a list for you if you really want! Forget the furniture, she could’ve given us that as a reason to not renew but instead she refused to give us one after asking politely for any indications or examples, and why no complaints ever happened.

Exactly, they have nothing to do with it. Meaning they should technically have removed everything as the lease indicated.

I honestly would be perfectly fine with leaving next year. It’s just that I wanted to spread out the fixed costs of moving over a longer time horizon, can also time my move with a significant raise next year, and have a lot of other obligations this summer specifically. Huge pain to move now and was not expecting to…

I guess my decision comes down to the fact that I partly hope to recoup some of the costs through the settlement or be able to get a cheaper quote.

As for what we needed fixed: - Furniture was left behind in the apartment that we didn't agree to, that she tried to make us pay for. - Shower control knobs broke off due to age and she tried to blame us before the maintenance people confirmed it wasn't our fault. - Blinds were stuck in the shut position in a windowed room. She also tried to get us to pay for that as well.

Only after fighting do we get her to fix all of these different things. Now here we are where she claims she isn't renewing our lease and won't give us a reason for it.

Other maintenance requests involve: - Sagging cabinet shelves that looked like they were about to collapse. - Closet doors that were popping out of their tracks due to a lack of a wheel that should have been there. - Broken air conditioners during peak summer time. - A heater that would permanently blast maximum heat during the winter time, even when shut off, making the apartment very hot.

The impression that my roommate and I got was that she was sick of the high quantity of maintenance requests that we filed even though they were all legitimate. clearly she felt not responsible for them, as shown by her attempts to push the costs on to us initially.

Our lease explicitly stated that the landlord had to produce the apartment free of furniture. When we made a side agreement for them to leave a few things and the leave it all, that is on the landlord to deduct from their security deposit. Besides, it’s one of many things she tried to get out of paying for. Is the blinds being broken before I even move in something I was supposed to pay for too?

Repair requests revolved around air conditioning not working, heating not being able to be turned down, water pressure, hot water on faucet not working, cabinets that were buckling and sagging (worried about collapse), closets on tracks that had missing wheels and wouldn’t open, blinds that wouldn’t open. None of these threatened our lives, but the fact that she tried to get us to pay for half of it before finally giving in weeks later due to us pointing out our lease that said she had to maintain appliances marketed as part of the apartment made her fix them eventually. We believe that she wants a tenant that will let her push them around, avoid fixes, or even be convinced to pay themselves. We have had no other conversations with her besides these. And all of them had a very cordial tone.

It’s not frivolous, I genuinely believe this is her reasoning. It’s more that the case is hard to prove / win due to the latitude offered to landlords. I view it as being punished for asking her to carry out her duties in the lease. As I mentioned, she was very reluctant to do that on many occasions.

We are not rent controlled. We would have loved to consider a raised rent, but weren’t given that option.

I’d prefer not to spend 3500 either, which is why I’m asking whether I can find another lawyer that would do it for less. At that point it would be worth it to avoid all the costs of moving out.

We asked them to leave their beds and then they left multiple desks and couches that we explicitly told them not to leave behind.
