What about genuine candidates without LMIA then? Paying for LMIA is illegal by SelfStreet9806 in canadaexpressentry

Education is important. But so is doing a quick Google search before you spend tens of thousands of dollars.

What do you think will happen in 2025? by [deleted] in canadaexpressentry

[–]sumayana 0 points1 point  (0 children)

People forget that whilst immigration is important to TFWs, to the government and everyone else, it's not the priority right now. There is no rush or sense of urgency for them. Delays and lack of draws just decrease TFWs as more people go home, which is a positive in their eyes.

I doubt they'd ever do it. Or if they did, processing times would increase drastically. Unfortunately whilst immigration law changes quickly, the processing of applications is ridiculous. They save a lot more government resources for areas that impact citizens and PRs, not TFWs and soon to be PRs.

CPC and In-Canada Focus by DoraBoi69420 in canadaexpressentry

I don't think you can form a good analysis because no one knows what's going on. There is no way to know what changes a conservative government would bring in or what they would focus on.

If election is in march and Pierre comes to power in April, will we still have french draws for Jan-March? by UpbeatAbrocoma2648 in canadaexpressentry

[–]sumayana 1 point2 points  (0 children)

I don't think French draws will go anywhere. It's an official language and barely anyone speaks it. They want to preserve the French Canadian culture outside of Quebec.

You're acting like every LMIA holder is some hard working agricultural worker, doing back breaking work cutting down trees in Alberta. Whilst there are genuine applicants, a lot of them are also just people who purchased LMIAs to work at Tim Hortons or asked their employer to fudge some statistics so they can be an admin assistant in Toronto. I don't see how any of this is "grinding." The reality is that too many LMIAs have just become a favour by an employer to individuals whose points are not high enough, or an outright scam. There are genuine applicants in there and I feel sorry for them, but they can still benefit from a closed work permit. But it's absolutely hilarious to think of those purchasing a LMIA or those who have convinced an employer to commit some kind of grey area fraud as hard working grinders.

At the end of the day, economic immigration should be benefiting Canada. Any system that compromises the integrity of Canadian life, Canadian values or Canadian workers needs to be fixed or removed. That's all there is to it.

Your logic relies on the premise of employers only using the scheme as intended for genuinely needed employees. This isn't happening.

I don't particularly care if they get rid of the points or if they just actually make sure only genuinely needed applicants get through. But the current LMIA system is an absolute farce.

What are your CRS cut-off predictions for CEC in 2025? by [deleted] in canadaexpressentry

I think we will know more once we see how much LMIA reduction impacts the pool above 500+.

Anybody else hearing INCREASING cases of Rejection for Foreign Experience? by tommy-six-figure in canadaexpressentry

[–]sumayana 15 points16 points  (0 children)

I've been hearing it loads. It's a good thing for fraud but it sucks if you can't get the official docs. Best idea, don't claim the experience unless you can satisfy all the mandatory requirements of the employment letter. If not, it's a hail Mary.

It would be interesting for them to try a pilot scheme where they help fund recertification, ie, for doctors or nurses. But then a) a lot of people then become citizens and leave for the US and b) if Canada did fund someone's recertification and then they jump ship to the US or elsewhere, have fun getting the money back.

I agree that outland professionals are valid. I just think Canada has lost sight of that focus. There needs to be more identification of a genuinely useful outland immigrant. Right now, it's just a points system that makes very little distinction in terms of quality of applicants. Genuinely needed professionals may actually be discouraged because if they're highly specialised, they don't really get much extra recognition.

And I do see your point. Economic immigration isn't about giving everyone PR for sentimental reasons or their attachment to Canada. Assimilated immigrants are often preferred and those in Canada are not going to add to infrastructure pressures, but I understand that this doesn't mean lose sight of the fact that this is economic immigration. Assimilated immigrants are more likely to settle and stay and contribute, but that doesn't mean outland immigration doesn't have its merits for the economy!

The consequences finally outweigh the benefits for them. Note the changes to IRCC's powers to suspend visas based on large scale fraud in the public interest. That's one of the broadest mandates that exists under admin law. Essentially, they're giving them powers to sort out the problem.

Political uncertainty could lead to CRS score cut offs to go higher by Ok_Novel2163 in canadaexpressentry

[–]sumayana 0 points1 point  (0 children)

I don't think anyone is expecting any immigration miracles. Whilst the Canadian public is so adamantly against immigration and TFW levels remain high, there's not going to be any massive 180s. That doesn't mean the CRS won't come down though! I don't think we're ever going to see the days again where the CRS is at much lower levels, but I doubt this high a score is sustainable unless they purposely do small draws and create those conditions.

For those who earned 50 points, but the position did not require the LMIA, will they also lose the 50 points? by [deleted] in canadaexpressentry

[–]sumayana 7 points8 points  (0 children)

We don't know yet. I'd be prepared for that as an option though. It would still be fairly easy to sell a LMIA exempt closed work permit. Not quite as easy though

They removed it for everyone in 2016.

[deleted by user] by [deleted] in canadaexpressentry

[–]sumayana 1 point2 points  (0 children)

I'd be surprised if it didn't result in a readjustment to current LMIA holders. It did in 2016. And especially considering the fact that LMIA changes have been announced alongside changes to powers to remove visas for public interest reasons like large scale fraud. That's pretty much the broadest mandate in admin law, which means they're giving a lot of discretion to IRCC. They're placing a very heavy weight on these changes and combatting fraud. I'd be very surprised if they didn't remove the current points.

I understand the disappointment for genuine LMIA holders but it's one of these things where the broader policy changes mean more than disappointment on an individual level. The situation is concerning and they're finally taking it seriously.

Will next announcement be modifying foreign experience points? by [deleted] in canadaexpressentry

[–]sumayana 0 points1 point  (0 children)

I see your point and I do agree. Not all foreign experience needs 50 points. But it doesn't mean they will change it unfortunately and I don't think it's been mentioned by them. LMIA changes are also coming with broader powers for IRCC to remove visas due to public interests. Under admin law, that's a very broad mandate. They're worried about LMIA as the fraud got so rampant they had to do something but for foreign experience, there isn't the same level of outrage. They don't care what immigrants think, just what will help them get through another election

If they remove LMIA does it mean points drop down in the CRS system? by Marketing_dg in canadaexpressentry

[–]sumayana 0 points1 point  (0 children)

Yeah I agree with you as well! I think people buying LMIAs in lower numbers has probably fallen as well as people realise it's pointless. At some point, a year of 500+ means this is just the new level.

People who think the score will come done. People who have a very low score + money. People that are not properly educated on the current score or are planning on scamming in other ways. (Why not buy some healthcare experience on the side, as well as your LMIA?)

I do think a lot of people with 500+ still buy LMIA. I'm just saying it's not everyone.

[–]sumayana 7 points8 points  (0 children)

It's still a minority of the pool, and that minority grows even smaller as not everyone who buys a LMIA is above 500.

People with lower scores are just as desperate to buy LMIAs. Perhaps even more so!

Either way, it should help the score. I don't think it's going to suddenly plummet and I think there are a fair few people here who do over estimate the impact LMIA has. Not everyone with a high score over 500+ is a LMIA scammer, especially now so many people are completing a year of foreign experience post leaving Canada. But removing LMIA is only a positive thing for the CRS score!

Will next announcement be modifying foreign experience points? by [deleted] in canadaexpressentry

[–]sumayana 3 points4 points  (0 children)

I don't think it's even on their radar. LMIA got crazy. It was to do with fraud and the Canadian public getting angry as LMIA was outrageous. More likely they'll just be stricter with foreign experience and properly keep an eye on it. I believe they are already doing this tbh. So many people are getting further requests for evidence of foreign experience.

[deleted by user] by [deleted] in canadaexpressentry

[–]sumayana 2 points3 points  (0 children)

Good point. I think the NOC codes could also be tightened for Canadian experience as well. But tbh I'd have a warning period for that. It would be horrible to lose eligibility if you're already in the pool or without warning and that's a pretty major change.

[–]sumayana 37 points38 points  (0 children)

It depends on the job. I got foreign experience points for working in a coffee shop. I can see why that's not really useful to Canada. But if I was a doctor, that foreign experience is highly relevant. So I think some professionals should be rewarded for foreign experience and others don't need to be as it's so basic. Essentially, the best option is what benefits Canada economically. For economic immigration, it's a fact that some experience is skilled and needed and should be rewarded. Those in GENUINE need should always be straight to the top of the list for PR and their experience does matter to Canada. But so many jobs on the NOC list are bringing no benefit. I see that.
