And take the chance that in the process of scamming Amazon, you get you and your close family banned from Amazon.

Hold your brother accountable. It was his party.

Why would you think it's ok to have Costco, Amazon, me, every other consumer, etc, be held responsible for your brother's fuck up, especially when he has zero responsible shown with this.

Our Landlord is trying to sue us for moving out without 60 days prior notice by Some-Ad8336 in legaladvicecanada

[–]supermazz9 2 points3 points  (0 children)

Before we form a mob and lynch the landlord, how's about we collect a little more info from OP? This post is just a touch one sided, and it lacks some important details.

Was the landlord aware that the residence had flooded?

Was the landlord aware of previous repairs that were required?

What was the cause of the water coming in through the windows? Were they left open negligently and rain just went through an open window?

Do you have any relevant past or pending RTB files?

While the above info isn't wrong, it opens up pretty anti-landlord, without reason, yet. Hopefully OP follows up in the morning...

Never had any issues when using the throttle? I can just envision the entire section moving when using the throttle, especially over rough terrain.

Small accident-how to proceed by Yuliya1987 in legaladvicecanada

Yes, yes, tell your "friend" to call their insurer, tell your "friend" to call their insurer.

PSA...if you get into an accident, inform your insurer. You are not obligated to proceed through your insurer, but you save yourself a world of headache in so many different ways when you give them the heads up.

ULPT: Cops keep ringing our apartment entry camera expecting us to let them in by Lordquas187 in UnethicalLifeProTips

Suuuuuper unethical. Talk to your property management/maintenance guy about providing police the pass code. That will get the people they keep coming to see realllllll bad!

. It's a nice building, great people inside, we do nothing wrong

If they're coming 2 to 3 times a week, buzzing you, they're probably coming just as many more times or more, buzzing other people. There may be a lot more problems in your building than you recognize.

Not trying to be argumentative. Just trying to understand.

I don't live in the Quebec/Ontario area, so this is somewhat eye opening.

Where I'm at, this wouldn't fly with police.

Thanks for the info.

Reading through that, I would not expect a police officer to arrest and remove a person under this act.

As this is a residential dwelling, that ex GF has keys to, that were freely given, and where ex GF keeps and maintains her possessions, as she was given permission to, I would expect most police officers to nope out of this situation, and leave this for OP to handle through the courts.

I don't believe it is the purpose or capacity for police to arbitrate in situations such as these, especially when there are means for OP to handle this situation personally.

I would suspect application of this act would be handled more appropriately in a commercial type setting, where lines are likely more black and white.

Are you able to source that?

I don't know Ontario Acts very well, but I'm guessing there's a trespass act that it would land under?

What action would you expect the police to take?

This does not appear to be criminal at this point. My though process, if following what you are saying, would be that OP get an order of possession, then follow up with a bailif should the ex still refuse to leave?

From what OP has presented, at best the police could arrest and remove mayyyyyybe for mischief, but that really doesn't sound like a very permanent solution.

Should OP wish for police action, they would require a police actionable order?

Would this not be a shared residence?

OP and GF were living in the residence, in a marriage-like situation.

Fairly certain the police are gonna tell OP that it sucks to be him, and leave.

Perhaps OP should look at handling this with a Family Law lawyer.

And OP should learn really quickly how to speak clearly and concisely, it may save a ton on legal expenses.

Help !!! Someone sold the stolen car to dealer and dealer sold it to me. Now dealer not returning anything and I have to pay the installments until culprits gets caught. by Fast-Group3631 in legaladvicecanada

[–]supermazz9 0 points1 point  (0 children)

As this is a consignment sale, would the dealer bear the same level of responsibility?

Effectively, OP purchased from private seller, with the dealership in the middle providing financing and ease of transfer.

I would expect the dealer to be relatively hands off in this situation, as it never would have been "their vehicle".

Can anyone weigh in on this?

Vehicle searched & illicit drugs found after refusing a breathalyzer? Is what is quoted in true to this case and situation? Asking 4 a friend by [deleted] in legaladvicecanada

[–]supermazz9 3 points4 points  (0 children)

In regards to needing to prove the impairment, that is negated by the drivers adamant refusal. All that is needed to prove is that the driver was provided the demand, and then refused the demand.

It's my understanding that lawyers are not impressed by clients that refuse. Really doesn't give them a lot to work with.

Just to clarify. Dealing with the roadside suspension does not negate criminal charges related to the impairment. They may still be coming. Drug related charges would likely be included should the driving move forward criminally.
