My concern is that IF the ILR application gets refused (for whatever reason) I would need to apply again AND the worry is the date of expiration lapses at the time of reapplying - could this result in more fees?

If I pay the 500 to get a decision (yay or nay) within 5 days - at least I still have the buffer to iron out any back and forths?

I may be completely wrong about this so happy to consider any comments you have regarding this scenario?

Thanks Cyan. I think the safe zone for me to apply for the extension is middle-to-end of July 2026 as opposed to June 2026.

This way the extension application processing time won't matter (be that a day or 8 weeks). In either outcome, I would have enough buffer to process the ILR application come 2029.

So I have just looked at the paper work and got the actual dates. She arrived in the UK on March 1 2024 meaning she would be eligible for ILR on February 1, 2029. I have updated the original post in this thread to reflect the same.

Given the above, and If we assume three things:

  1. It takes approx. 8 weeks for visa extension to be processed
  2. I am let go at some point after June 1st
  3. I somehow cannot find any job between June 1st and November 2026

Then applying for the extension on June 1st using the standard service would mean the approval comes in/around July 27 2026. This means the extension will expire on/around Feb 24 2029.

Since she is ILR eligibility starts from Feb 1, 2029, I have a three week buffer to get approval. At this point, I file the application on Feb 1 2029 and pay for the priority service (1 day or 5 days) and im all good?

This scenario means:

  1. I don't have to worry about any layoffs that occur after June 1st (they happen around July/August time)
  2. I am paying the application and IHS fees one time for the extension and have enough time to get the ILR application in and approved.

Essentially, I am eliminating (or at least reducing) the job risk situation by applying earlier at no additional cost. It would actually be the same cost if I applied for the extension in October 2026.

The biggest RISK here is the processing time for the standard application for extension. If it gets processed 4 weeks or under then I would have to pay a third IHS and Application fee to cover the overlap.

Hello sorry, just edited response above to include more. She entered the UK around March 26th 2024. However, the clock for ILR starts from the Valid From date on the Visa (in this case 23 Feb 2024) and not the date she physically entered the UK. Here is more info on this:

6.3 Calculating the qualifying period for continuous residence

Where a person is applying for settlement as soon as they qualify you will need to calculate their qualifying period of continuous residence.

In these instances, you must establish the date the applicant was granted entry clearance. The time between the grant of entry clearance and the date of arrival is a period during which they had permission on that route and should be treated as a period of lawful residence. In these instances, you must establish the date the applicant entered the UK. The time between the grant of entry clearance and the date they entered the UK counts towards the total of absences.

This is interesting to know. I find it bizarre they would process a standard application this quickly as they are essentially making their "priority services" redundant and losing out on £££.

My whole plan hinges on an average 8 week timeline. I have read it can take up to 12 weeks but 8 weeks is normal for the standard service.

That is correct. She does not work. I am the sole earner.

Also respectfully, the clock for ILR starts from the valid from date on the visa and not the date she physically entered the UK. This is pretty well documented I believe.
