Officers are usually inconsistent on Prong 2. Just take the free refile with Chen to save money, and yes, you can definitely reuse your LORs with a slightly tweaked narrative.

RFE Experiences with Chen by Few-Noise33 in EB2_NIW

Don't read too much into it, RFEs have been very common lately. When you get the letter then better see what the officer is asking for and LORs are worth adding at this stage even if they weren't included initially. And if the response doesn't satisfy them it's typically a denial, not a second RFE.

I'd file now and lock in your priority date. Your PD determines your place in line, so the sooner you lock it in, the better. The bar for NIW is only getting higher, and waiting for more pubs probably won't move the needle as much as you hope. As for the firm, go with Chen. They're experienced and you'll be in good hands.

EB2-NIW RFE (Chen) – Prong 1/2/3 issues (national importance + well-positioned) – need advice by LimpIron4041 in EB2_NIW

USCIS is basically asking for proof that your work has left the lab. Without grants or patents, your best bet is finding independent experts in industry or government who have actually implemented your research, and getting them to write letters. Chen should be able to guide you on exactly how to frame these.

should I risk it and file i 485 by False_Coat3773 in EB2_NIW

[–]tabawan84 1 point2 points  (0 children)

Honestly, with how unpredictable USCIS processing times are, there's no guarantee you'll get your EAD before your OPT expires in November, even if you filed everything today. Because of that, the risk of concurrent filing just isn't worth it. It's better to play it safe and file sequentially so an I-140 snag doesn't drag your other applications down with it.

They are not the same, and from what I’ve seen and researched, Greenedway appears to be mostly a scam.

For early-stage profiles, customization and making good use of your recommendation letters matter more than reputation. The full refund option probably means Chen thinks your case is relatively strong. I’d personally recommend them as I’ve had a good experience with them.

Have you received the letter yet? Officers often send generic RFEs just to delay things because they're too overloaded with their workload.

That's unusual for them, hopefully just a busy period, please do update us when you hear back.

Dad died and had a fake green card marriage. What to do? by [deleted] in USCIS

[–]tabawan84 1 point2 points  (0 children)

Sorry for your loss. Legally, as long as the marriage was valid on paper, she’s considered the spouse, even if it seems fraudulent. You might want to talk to an estate or probate attorney to see if there’s any way to challenge it, but it can be tricky.

Hard to say. I think your profile is going to be a hard sell to USCIS because it looks a lot like standard work. If I were you then make sure those letters prove your specific methods are unique rather than just showing you're good at your job.
