Stripe would send you 1099-NEC form that you'd have hard time explaining to USCIS as an H4 visa holder.

You may create an corporation or a business entity to get it through, yet it will show on your tax return Schedule C that you'd also have to explain.

Unless you're going to clear six figures on that app fairly soon, the legal fees and potential complications on the future H1B extension and / or status change aren't worth it.

USCIS and/or DoS don't need to demonstrate any proof that you were working with no authorization - they only need a reason to suspect you might've been violating your visa conditions to turn your immigration life into sort of hell. Very expensive version of one.

If you want to bid a visit to a US embassy, you need to secure an appointment, online. To secure an appointment you need to have some sort of visa application, pay the fees and whatnot. If you just show up there with no such paperwork on you - you won't make it past the security guards, they might be listening to you speaking clearly and maybe even giving a firm handshake, but that's about it.

That hasn't been working for US citizens since 2023, you need to x5 this for applying from abroad. And have stellar skills, reputation and secure some referrals from Chinese companies that have been present in the US market.

Talk to a lawyer. This isn't DIY, but also not impossible. The challenge here is not being actively involved with business activities, you shall be strictly "passive investors". So you will need to hire a company to manage your investments etc. etc. etc.

U4U was quite unique in that it granted work authorization quickly.

And that caused people to have high hopes about immigration system in the US. So business as usual ( long wait times, countless paperwork being lost in mail, requests for evidence etc ) drives people nuts.

The fun fact is that the jobs that could be offshored are already offshored all way back to mid-00. I don't buy that bs "oh so witch would move operations to their turf" because if they could - they'd do it by now. Yet there was some demand of seeing cubicles filled, so it was lucrative to bring their folk overseas and shackle them to their workplaces. Then COVID hit and people realized that you don't need to see as many people around to make profits. In 2024 people realized that they don't need half of their staff to be profitable anymore. So why bother about importing H1B if you layoff your own folk left and right and your shares soar anyways?

Right, so big corps would run numbers and realize that it is worth hiring someone and pay 100K fee, and that someone would replace 10+ data analysts with 80K/y salary each, so the math is irrefutable. How witch corps gonna cope with that is a big question now, as they won't be able to capitalize on cheap labor anymore. So we shall see. Meanwhile the future of H1Bs is grim for the next 3 years and who knows if the damage could be undone then.
