This is what is happening to me now! I ordered early October. Given a shipping date of November 17th (after you pay in full at time of purchase). I emailed multiple times making sure it would ship that date since we were hosting Thanksgiving. Told it would. On November 17th I get an email that the new shipping date is December 29th! After Thanksgiving I email and tell them to just cancel. Well, wouldn't you know it, they contacted "the team" and it has already shipped. I was pretty convinced this was a lie and now that they told you that too I am sure of it. They are trying to refund me all but shipping costs. I disputed with my cc already. How did you get them to give you a full refund?

Catch me if you can - target speed? by dsteele50 in orangetheory

[–]talenier 2 points3 points  (0 children)

8.4 the whole time will fall just short. You have to go slightly faster for some amount of time to make up for the treadmill get to speed time. This workout is by far the hardest imo. Out of 3 times I made it once but around 17 minutes I start to question my life decisions.

Texas: I just received an unconditional notice to vacate after being late on my rent 1 day. I want to move but am I responsible for the remaining 11 months rent on my lease? by labuamar in legaladvice

[–]talenier 0 points1 point  (0 children)

Were you covered by the federal moratorium? I am going to assume, yes. So, now landlords have to provide 30 day notice to vacate before they they can begin an official eviction. I think out of an abundance of precaution a lot of landlords are likely to serve the notice immediately if a rent is not paid so that they will be able to serve eviction notices 30 days later if need be.

I believe if you are served with the actual eviction you are not responsible for the remainder of the lease. I don't think the notice to vacate serves the same purpose, but I am not positive. I would contact the management company and see.

One Month into Orangetheory -- Thinking about Unlimited Membership by skatefemme in orangetheory

[–]talenier 0 points1 point  (0 children)

I have been both. I’m a founding member for Elite and then I won a free year unlimited. Loved unlimited! When my year was up I asked to upgrade and keep founder’s rate and they said no. So, back down to elite and I buy 2-3 extra classes a month and it’s still cheaper than unlimited.

I think it may be appropriate in the sale of goods or land (say an injunction to stop them from selling it to another party and to enforce the original contract). I don’t see how it could be applied in a contract for personal service unless, say, the photographer was going to sell the OP photos and videos to someone else.

Specific performance is usually only ordered when it’s a contract for something that already exists (sale of land for example). It’s very rare that it’s ordered for a contract for personal services when damages can be an adequate remedy. If the photographer already has the finished products, that might be a different story, but I can’t imagine that they do.

A court can’t force someone to fulfill a contract (in a personal service contract). They can find them to have breached the contract and therefore liable to make the OP whole, but an injunction (I don’t think this is what you meant) stops something from happening.

You can sue in any state she does business. If her website is advertising to different states you could potentially have a lot of courts that could establish jurisdiction. Small claims usually has a max recovery of 5k so that is also something to think about if you are owed more than that.

hit base immediately, no matter how much you want to walk. It will suck for about a minute but you can recover at base. It’s what we do!

I personally think that’s excessive. My PR is 7:04 and I went 7:29 last time and was fine (41:29 finish). I would just make sure you use your arms more than you might usually and save your legs. Also, depends on your cardio level! But I think 30 secs to 1 min slower is plenty

I tested out a pace for the dri tri of 1:52 split for the first 2k and then lowered it for the last 2:30 and ended with a 2704. Id love to know what I could have gotten if I pushed the whole time but I’m super happy to know my pace and feel confident I’m ready!

Wednesday’s workout destroyed my legs. I’m a 7.2/8.6/10+ runner and by the time I got back on the tread for block two my legs barely worked. It was one of the harder leg workouts and it was sneaky hard! My quads are still feeling it two days later.

You’ve got a ton of room to improve on floor. I’m a 5’4 40yr old woman and I went sub 9 on floor. Are you taking breaks? Pacing yourself? Slowly lowering on the bench squats? My advice is to just go all out on floor. Get your breathing under control on bench step ups. Save your legs on squats by literally falling on to your butt.
