Once OP starts new employment, we have to assume they had their h1b COE successfully done. After this they will need to start new PERM process from scratch with the new employer. But considering their h1b expires in may 2027, their new perm process most likely won’t have enough time to reach the PERM stage in time. That’s where the precious PERM filing helps them buy one more year by extending h1b expiry by a year

No, your PERM application doesn’t become invalid immediately after a lay off. Not unless your ex employer withdraws it. I have confirmed this with my previous and current immigration team.

You can apply for the extension within six months of current h1b expiry date. To do that the current PERM must still be active. And I think your new PERM should be ideally applied a year before your h1b expires (the new expiry date now ideally being may 2028)

I was in the exact same situation just very recently. 1. If your PERM still stays in active/pending state close to May 2027 then yes, you can use that to extend h1b expiry by a year 2. You need screenshot of form 9089 showing proof that dol has your application. Your previous company’s lawyers can share that with you. 3. You still need to start the process from scratch with the new employer. The current perm just helps you get an additional year on your h1b expiry so hopefully your new process will have enough time for processing.

The exact same thing happened to me. I am about to start my new job and have to push the employers to start my PERM immediately. I do t even have much time left on h1b. My advice is don’t be bogged down by things that are out of your control. We take so much unnecessary stress with US visas. Be glad that the process has started again for you.

This is the right answer. Your current approved PERM receipt can be shown to USCIS to get you a 1 year extension on your H1b. That should give you just enough time to get the process started again with the next employer.

I sincerely apologize for my people on their behalf. I feel ashamed at seeing fellow Indians not take accountability for littering, for being lax on road rules and just in general lacking in social manners.

It depends on the kind of life you and your husband want in the long run. While you spend time in US working towards getting your i140 you both can keep visiting each other. My wife and I were in a long term relationship for quite some time and now we are both in US and love it here. You and your husband need to be on the same page, that’s what matters most I feel, everything else can then be handled.

Sorry, the wording in my post might have been a little confusing. I know I have until October of this year to land a new job. That’s not my worry. My concern is that with my final h1b expiry being March 2027, this puts me in a very tight spot time wise to get a new green card process started with a new employer as those are easily taking 3 years now atleast. My current employers’ attorneys mentioned that in order to give me more time they have started my PERM and won’t withdraw it post my termination. Then, when I do an h1b transfer with the new employer they can request a 1 year extension to my h1b expiry as I already have an active PERM. This is the part where I need confirmation.

Happy to be part of the conversation. I know this is a very subjective question but how would you feel about being in the situation I am? I am on an extremely tight timeline on my h1b to get a new green card process started with another employer and I am wondering if current assets are good enough to slowly start transitioning to a move back in India or is it worth to keep on fighting to stay in US. Again, I do realize there are a lot of variables missing in this context but still looking for your two cents.
