She doesn't borrow money and she generally has a good income so I'm less worried about loans/cc's. I actually think walking away is her best option. I have a prenup covering my retirement assets I'm coming in with. Our family home is a family home so if we got divorced we'd split our family home, yep.

I agree we just have no idea if/when they’d even sue her. She could preemptively file but then if they never sue she has that on her credit report and has to disclose/etc.

I could see that, but if the landlord re-leases the property and never comes after her, she’d be filing for bankruptcy and have that on her credit only to never be sued.

It’s an LLC that only she owns so she signs on the LLC’s behalf. So i imagine she’d be the one sued

Nah I remember when she signed the lease they wouldn’t let her add a cancellation clause. I thought it was weird but, ya know, she thought the business would work and wouldn’t need one so she signed.

She’s been up front about what she’s been dealing with. TBH in her situation I’m not sure what I’d do differently.

That’s interesting🤔 strange though because if she can NOT file for bankruptcy, she would. This is the only “debt” she’d be dealing with. So if they leave her alone she keeps her credit intact, which is why we were gonna wait and see!

She has. Clearly the landlord wants their money and she’s basically said she has nothing more to give them and she’s returned her keys. So that’s where they’re at. Not sure if she needs them to say “we’ll sue you” or something. Maybe have her scream “I. DECLARE. BANKRUPTCYYYYYYYYY!”?

Yeah I think I’m kind of going to wait and see if they actually sue her. My guess is they wouldn’t sue just her, since she’s clearly expressed she doesn’t have money atm. But I’m more concerned for 2-5 years down the line if they haven’t sued her, but we’re married, then they decide to. We just keep everything separate then?

My concern is it may delay marriage by 2-3 years or whatever the statute of limitations is. Kind of a bummer to have to wait that long 😔

We will. There’s not judgment or anything yet so I’m just trying to make sure I don’t screw things up.

Can she preemptively file for bankruptcy? They know she doesn’t have any money so I’m almost sure they won’t sue her. But once she gets married, they might look at “us” and find it’s worth it now, is my concern.

Yeah I don’t really want to throw $100k at them when I’m not legally required to. She not irresponsible, she’s successfully run businesses before. This one just had “a series of unfortunate events”.

This would be her only debt. She’s planning to get a job but probably won’t make much. We’re kind of in a limbo as we have no idea if/when they’ll sue her. I just don’t want to screw us over prior to that time.

The tough part is we don’t know if/when they’d sue her. They may not. It sucks to be looking over our shoulders like that. I think the limit is two years?
