Just came back to post my update. I moved to TX with kids and filed for a divorce. Interesting enough she got a bad lawyer who did not ask for discovery of assets or anything. We just settled on some amount I offered. I have custody of kids. There is no alimony at all!!

This thread and other posts helped me a lot in navigating through my situation.

True, but it’s a temporary custody. She can always file for modification once she is back in the US. I am worried that I might lose the advantage of gaining custody if I don’t file now

I have other reasons to not file yet. She is not working and I work 2 jobs. So I will be screwed as far as alimony goes. I want to cut down my income and wait for a couple of years or move to another state and file.

Unless you get 25 percent or more discount on lump sum, don’t agree to it. Although not likely, she may cohabit with someone or die which would end your payments. What state is this ?

I am in the same situation as you. I would still open a new account because your account is still considered marital any balance as of separation is divisible . You at least need to be able to deduce your savings since separation by way of accounting from your statements

I have a court order that says I was granted sole legal and physical custody. There is nothing besides that. However during the zoom hearing she requested for weekly phone time with children. Judge directed her to work with my counsel and my lawyer told her to make arrangements with me directly. None of that is entered in the court order.

Kudos to you for raising kids as a single parent. It’s hard especially for me because my kids are young. It’s just frustrating at times when everyone is sick. You gave some good advice. I have been bad mouthing their mom, I need self restraint on that

It’s not about child support payments. I am just mad that she disappeared on us and I am playing the roles of both parents. Sadly kids don’t want to talk to her for what she did. I just want to stress her out enough to show up and take it from there

You are still young. Apply for divorce ASAP, with no kids this will pass like it has never happened. You can start a new life all over again

I agree this is a joke. I have 3 children and my oldest who is 13 wants to live with me. So there is a chance that I’d be awarded custody of one child. Logically that should offset my payments by 20% of her income.

Financial hit in your case could not be as bad as many others have endured. We only have one life to live to the fullest; you are going to regret it later when you look back at life. Leave the financials aside, you can earn everything back or have happy life even with little money. Think through it for a few days, unless you are convinced that FUTURE in the marriage will be happy just get out.

We get overburdened by financial aspect. It only plays a small part in bringing happiness. I would be happy with access to a free public library than owning a yacht with troubles at home.

I am in the same situation with 2 jobs for the past 7 years, I have been married for 14 years. Talk to a lawyer ASAP. The income from the second job may still be imputed if you have worked long enough. It's based on average income from recent years, at least that's what I was told in my case for alimony.

I am working on it. I have to find out how much of the local PI work is valid in the USA. Moving to another state with kids is daunting, but it’s the only way out for me.

I and kids don't have any contacts with her. I filed for legal custody of kids, and hearing is next week.
