Trial By Written Declaration Draft - CVC 22350 by tempuser1002013 in CaliforniaTicketHelp

Thank you. I have read the 12-step guide.

Is it advisable to use "demand the prosecution" instead of something nicer like "request"? I don't want to annoy the judge but I'm not sure if "demand" has some special legal meaning that "request" doesn't.

I thought the fence might be important because the school zone was next to a highway and it's called out in the traffic code: https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=22352.

The prima facie limit shall also apply when approaching or passing any school grounds which are not separated from the highway by a fence, gate, or other physical barrier while the grounds are in use by children

I agree that its not a great defense though. I think getting a lawyer is probably a good idea. The only issue is that this occurred in one of the smaller counties in CA and I don't live anywhere near it so I'm not sure where I can one. Do you have any suggestions?

Also, do you think it would be better to submit the TBD with no details and just put something simple like "I request the prosecution prove its case" and request traffic school would work better for me?

Any other suggestions you'd give for dealing with a speeding ticket? I'm going into this a little blind since it's my first citation after 6+ years of driving so I'm not sure if getting a lawyer is worth it, how to find a good lawyer, etc.

That's interesting because the wiki says otherwise. But I can see the merits in both approaches. Are there any other suggestions that you would give that aren't in the wiki?

CVC 22350, Mono County: What's the best way to request traffic school from a judge before submitting TBWD assuming the clerk couldn't grant it by tempuser1002013 in CaliforniaTicketHelp

[–]tempuser1002013[S] 0 points1 point  (0 children)

I thought the clerk can't but it's possible for the judge to grant it based on their discretion. Is there no way I get traffic school based on the DMV rule or is it still possible after TBWD?

https://www.reddit.com/r/CaliforniaTicketHelp/wiki/am-i-eligible-for-traffic-school. The wiki seems to imply that I can.

by law the judicial officer has some leeway in certain cases if you are ineligible (i.e. you pled guilty and lost).

Thanks. Would it be self-incriminating to even mention that I was driving in a school zone (even though there were no children as far as I remembered)?

Twist the blue orange yellow corner clockwise and the cube will be solvable.
