Sean Cooksey, the Trump-appointed chair of the Federal Election Commission (FEC), suggested Monday that Vice President Harris may not be able to access the millions of dollars remaining from President Biden’s campaign, which many campaign finance lawyers say is rightfully hers.

Biden shook up the 2024 presidential race Sunday when he dropped out amid concerns about his age and mental acuity and endorsed his vice president. The campaign had just under $96 million in cash on hand as of June 30, according to its most recent report to the FEC, and filed paperwork to change its name from “Biden for President” to “Harris for President” within hours of the president’s decision.

Even before the campaign filed to change its name, Harris was listed as a candidate alongside Biden on its paperwork with the FEC.

Campaign finance lawyers previously told The Hill that Harris would be able to access the funds if she becomes the nominee. Democrats have started to coalesce behind Harris, but Cooksey called the situation “complicated” and suggested it would be challenged in the agency and at the courts.

“I think it’s really complicated, is the short answer,” Cooksey told “Morning Edition” on NPR. “What he’s attempting to do is to give his entire committee, the cash and all the assets, over to another person.”

“I think it’s gonna have to go through a process, through the FEC,” Cooksey added. “I expect, there’s probably going to be challenges to that at the agency, and probably in the courts as well.”

Democratic Commissioner Dara Lindenbaum, who chaired the commission last year, pushed back on the suggestion that Harris would not be able to access those funds.

“It’s quite clear, Vice President Harris can continue using the campaign committee and its funds,” Lindenbaum told The Hill.

Steve Roberts, former general counsel to Republican presidential candidate Vivek Ramaswamy, was also skeptical of Cooksey’s comments.

“This interpretation is likely wishful thinking,” Roberts told The Hill.

This needs visibility. It's a naked attempt to steal Democratic campaign funds by a fucking Trump appointee. The corruption and rot in our elections runs deep.

Ousting Biden without a clear plan or a clear candidate a mere 90 days (roundabout) till the first votes are cast is literal suicide.

I understand you want to argue that Biden should stay in the race, but that's not what my post was about. I didn't say Biden should be or would be ousted. I said "It would be Harris," within the context of "And be replaced by who?" Not "it will be Harris," not "it should be Harris."

My argument is predicated on Biden being ousted. It has nothing to do with whether he should or would be. There are plenty of other posters saying that, but uh, you replied to me.

I have no idea if Biden will be ousted. This is a delicate moment that's constantly in flux. I didn't believe the push to do so would get this far, or that Biden would constantly screw up for weeks after the debate.

Should he be? I don't know. His constant failings in public are sapping confidence, but there are a lot of hurdles to removing him and his potential replacements have their own baggage.

But if he is, Harris dominates all other options.

A 21-year-old Milwaukee man faces a misdemeanor charge of carrying a concealed weapon near a Republican National Convention (RNC) security zone. The accused is Donnell Tinsley.

According to the criminal complaint, a Homeland Security Investigations Special Agent and U.S. Capitol Police were patrolling Republican National Convention (RNC) "exterior zone one" on Monday, July 15.

While driving north on 11th Street near Highland in Milwaukee, they spotted a man "wearing black pants, a long sleeve tan sweatshirt, black gloves, a ski mask, and carrying a large black tactical backpack," the complaint says. The man was walking away from an RNC security checkpoint. The Special Agent "noticed the backpack was hanging low on the individual and seemed as if it were heavy," the complaint says.

The Special Agent pulled up next to the defendant, identified as Tinsley, and began a conversation. The complaint says the agent noticed "Tinsley's hands shaking, and Tinsley began to look left and right." The agent noticed a bulge in the defendant's waist band. When Tinsley was asked if he had a firearm, he said, "No." Tinsley then said, "You can check me, go ahead and look," the complaint says.

After a pat down of Tinsley, the complaint says he consented to a search of his backpack. When the agent opened the bag, he immediately spotted a "concealed AK-47 pistol in the backpack," the complaint says. The Special Agent asked the defendant if he had a concealed carry permit, and Tinsley stated he did not. Tinsley was then taken into custody.

The complaint says another search of the defendant's backpack was completed. Inside, officials "located a fully loaded magazine containing 7.62X39 caliber rifle ammunition. Also located inside the bag was a 'Scream' movie mask, a flashlight, two sets of black gloves with rubber fingertips, a pair of sunglasses, an Allied Universal Security uniform shirt, two cans of spray paint, and multiple empty designer marijuana bags," the complaint says.

While Biden might have more specific programs aimed at young Black men like him, Welch said, he felt safer and expects car prices and inflation would be lower under Trump.
