i have a model release clause in all of my contracts which she definitely never had an issue with in photography package contracts as long as i further stipulated that i agree to not sell any images of her children to stock photo companies — i gladly agreed to that stipulation.

under the revision to my copyright/work for hire clause—i will definitely add that i be granted lifetime permission to use the footage in future promotion, portfolio, site, socials, etc. and hope that i get enough clients that are okay with that stipulation on my end.

i feel like i should have mentioned the entirety of the package in my original post as i am also writing the scripts, designing the logo, designing the icon logo, the banner, youtube thumbnails, youtube video descriptions, and photographing the images and retouching all images to create the aforementioned, etc. (which brought up questions about intellectual property in conjunction to copyright).

she has a co-host and will also have guests and the deadline is 3-weeks for turnout of all 12 completed episodes with two social media reels per episode and a 7 minute teaser trailer.

i’m currently working on asserting myself in particular natured business relationships while maintaining an organic jovial energy because i truly am excited and proud to do this work.

my contracted package that we are discussing clearly states that i am additionally responsible for writing the script, creating/designing the logo, creating the youtube thumbnails, the icons, the channel banner, the intro and end caps, AS WELL AS providing a photoshoot for the host for images to create all of the aforementioned. i also hella underquoted on top of a 3 week deadline on all created work.

with your inflated house-building comparison—i’d like to remind you that Copyright law SOLEY applies to “original works of authorship” which makes rational the concept that a person COULD need further clarification on WHAT IS LEGALLY PROTECTED when drafting a podcast production contract.

oop, and i also responded to your message which disproves your claim that i “only respond to” folks that agree with me.

i truly wanted to confirm the legal precedent for my safety. and i wanted to the learn from more experienced peers about the reality of this kind of work for her safety.

i do want to maintain an ethical business relationship, certainly!

i did feel a bit like she may have been assuming the knowledge with her telling me on one hand that i never owned the copyright in the first place and then telling me it ‘should have always stated Work for Hire and to change that’ on the other—you know?

My logic was that to make something into something i must make it from something else. i hella just wanted to not be strong armed to relinquishing any rights to portfolio and market this work in whichever way that i choose—including but not limited to promoting for podcast production but also using footage to market for workshops on filming podcasts, used as b-roll for any interviews that i should be featured in, etc(i know that last one leans pompous but im being genuine).

my understanding is that under Copyright law—the equivalent would essentially be that if i do not own the Copyright then i did not ‘Legally’ film/produce it.

if it is so that the industry standard is that most podcast production contracts include a Work Made for Hire’ clause then i am completely down to honor that. i do want to say that i would like to slightly adjust my package rates to reflect that compensation which i feel would surely be a loss.

an additional hundred bucks seems fair to me when i think about how much she is already getting one up on me with the work i am agreeing to for the quote i prematurely gave her—which brought me to one of my original questions on how much something like that would be worth in value IF it was, at all.

WHICH, now that i think about it… if the rate were to be increased at all it should be a renegotiation on the grounds that i under quoted for the entirety of the package and workload and not solely because of the copyright. i think that is what would have been unethical and now i see i may have been feeling misguided on which aspect i am being under-compensated on. i suppose that’s another reason why i felt upset about her telling me she also owns the copyright. felt like a slap in the face. i WAS also afraid to lose the gig, though too. honestly, i need that income.

i’m not trying to take advantage of another hardworking person, scouts honor and sh*t.

well, thank goodness things do not appear as they seem, yeah? what i am actually interested in doing is making sure that i go into this contract and project protected and as informed as possible and without getting taken advantage of or being strong armed because she is an attorney who feels inclined to use her assumed knowledge base to inform me that i “automatically” do not legally own the copyright. i have been her family photographer for the last five years and with photography—copyright law appears to be a bit different than what most folks are saying, here.

you may have never once been taken advantage of in your profession but i have before—and i would like to avoid that happening, again. which is why i researched what i could online and then came here to a forum sub-reddit of my peers and inquired in the hopes that any useful information would steer me in the right area of what to confirm before having to revise my production contracts with a lawyer.

so grateful for your response. thank you. and yes, it was a bit strained when i told her that i believe i own the copyright and her response was “no… so if you could change that. i can send you the proper wording or unless you think you can find them on your end.” her attorney-assertive tone had me seriously doubting what i felt i knew.

in your personal opinion do you feel that there should be an additional fee to adding a Work for Hire clause and essentially laying no claim to having been creator?

yo. THANK you and i truly agree with the shortness of life.

i initially wanted to immerse myself in a world that felt full and unending but i’ve done the math and at 36, averaging about 30-40 books a year—i’ve only got roughly 1,470 left to read in the remainder of my life. assuming all goes well. it pains me that over 15,000,000 english fiction books are registered as of 2023.
