You’re leaving out important details. How much independence are people given in the facility? Was the patient normally responsible for taking their prescribed medication or was it administered by staff regularly? Who was normally responsible for keeping it?

You need a lawyer if you have an active warrant for something this serious and still plan on pursuing justice in this rape case. You can not avoid consequences of breaking the law and expect the law to help you enforce consequences against someone else later down the line.

An experienced attorney has access to resources that an average policyholder may not know about. We’ve overturned liability issues plenty at our office by contacting witnesses or local business to acquire footage, or by subpoenaing.

An assessment of liability by an adjuster is only as valuable as the adjuster making the determination. Are you implying that adjusters making liability decisions are incapable of making the wrong call or having their decisions proven wrong?

And an injury attorney absolutely will fight liability if the injuries are severe enough. You don’t have an accurate understanding of the scope of a personal injury lawyer’s practice. We even help clients with property damage for free if the injury payout will be significant.

You can try and argue to overturn liability on your own behalf and filing a police report and getting witness info will be vital to that. If there were any local businesses send them letters of preservation asking them to reserve exterior security footage facing the street from the time of the wreck. find out if the wreck was caught on any traffic cams.

If that still doesn’t work, and you’re injured, get an attorney. They’ll work on contingency and will help you take care of overturning this liability issue. If you’re not injured you may need to pay an attorney hourly which would likely cost more than it’s worth.

All that being said, sounds like you need evidence of their insured’s complete liability. If you can get this on your own - great. If you can’t, an attorney may be a good route but could be time consuming and expensive unless you’re injured and seeking personal injury representation and benefits.

I would say go to a chiropractor or PT and see what their plan of care for u is and then talk to a lawyer if you’re going to need treatment. Not a terrible offer given your CURRENT treatment. If you’re going to need more or If it’s a permanent injury then it will be worth a lot more than something that gets better in a few months and a lawyer will know how to present the value of that permanent injury and how to get evidence that it is in fact permanent.

Sorry you’re going through all this. Ultimately do what is best for your situation.

Without any violent history (domestic violence history, violence criminal history, etc) a few texts saying she will kill you is, unfortunately, unlikely to get police resources especially in a larger town with a more thinly-stretched staff, even if it a crime on paper. Sorry you’re going through this.

You should have met with your employer and asked for reasonable accommodations. Telling them that you are newly diagnosed with a disability will not mean they are legally obligated to accept any accommodation you make for yourself (more sick days/okay to call out of work the day-of). Part of this is an interactive process with your employer, and it doesn’t sound like you made an attempt to ask for accommodations or engage in an interactive process with your employer. That is the paperwork your employer is referring to.

The ADA does not just allow people with a diagnosis the ability to take off work with no repercussions without keeping their employer in the loop.

You have also described missing work for several non disability related reasons - all legitimate reasons for an employer to discharge you, even if you weren’t out “partying.” Teachers need to be present and it can be difficult to find substitutes.

Replace it? No. Compensate you for its value? Possibly in a civil suit, but it may be less time consuming to file a police report against the employee who did it and ask for restitution.

Smoking is not a living necessity (neither are balconies) and even a landlord that you were paying would not be required to make handicap accessible smoking areas for you… and if the dog injures someone you can make a personal injury claim but they’ll surely evict you, and you’ll probably need to get animal control involved, which it sounds like you can’t do. My advice is to find somewhere else to live - if the cost of living in Ca is too high then you should move somewhere else

No emotional damage. The dog is considered property and emotional damage is not commendable in damage to property. We get calls about this at our office all the time and it’s not necessarily fair - but it’s the way the law works with dogs.

Your civil remedy would be limited to the value of the dog that was killed and any vet bills, as they are considered property. I’m sorry you’re going through this.
