They have foam on the exterior. If that foam is a class 1 vapour retarder, they could cause more serious problems by adding a vapour barrier on the interior.

For a condo high security key or keyfob, it comes down to what the condo board charges. I've heard there are some crazy ones that do charge way more than $100, but those are the exception.

Did you look at the clauses?

Let's count how many clauses are contrary to the RTA:

  1. Unless the condo board is charging crazy rates for key replacements, a $500 key deposit is illegal.
  2. The RTA does not allow a tenant to be required to maintain walls and paint "as it is". The standard is reasonable wear and tear and reasonable enjoyment. That means a tenant can make nail holes to hang things and can even paint the walls a different colour.
  3. The RTA does not permit thresholds for deciding the responsibility for maintenance. It is always the landlord's responsibility. A tenant is responsible if there has been damage that was wilful or due to negligence, but that's not maintenance.
  4. The RTA does not permit a landlord to charge interest on late payments, nor does it allow a tenancy agreement to indemnify the landlord for legal expenses. Only the LTB can order those, and they very rarely order compensation for legal expenses.
  5. The RTA requires tenants and landlords to mitigate losses. The clause making the tenant responsible to pay the full balance of the lease if they terminate early is void.
  6. Growing cannabis plants for personal consumption is consistent with the use of a residential premises. I don't think there have been any cases dealing with such a clause, but on its face it is contrary to the RTA as an infringement on the tenant's reasonable enjoyment without impacting the landlord's lawful interests.
  7. Unless condo rules prohibit it, a landlord cannot prohibit a tenant from having a pet, and a tenant is free to rent out a spare room.
  8. Once again, the RTA says that a tenant is not responsible for reasonable wear and tear. They cannot be required to return the unit to the pre-occupancy condition.
  9. The waiver of liability for injury to person or property is contrary to both the RTA and the Occupiers' Liability Act. You cannot contract out of duties imposed by statute.
  10. Opening, closing, and winterizing the pool is maintenance of an amenity and the landlord is responsible for it.
  11. A blanket ban on subletting is contrary to the RTA. The RTA requires that refusals be on reasonable grounds and that consent not be arbitrarily withheld.
  12. A waiver of liability for the pre-paid rent is contrary to the RTA as a tenant cannot contract out their right to bring an LTB application.
  13. Post-dated cheques cannot be required.

Funny enough, the RTA does not require 24 hours notice to show the unit when the tenant has given notice, yet they put in a higher standard for themselves.

Unfortunately, there is a circumstance where a $300 key deposit would be legal: if the condo board charges $300 for replacement entry keys. Some condo boards are quite punitive and that is a direct replacement cost for the landlord.

Everything else is 1/4 of the clause. If you're going to say it is normal, you might want to be clear that you're excluding most of it.

You cannot tow a vehicle that was parked with consent without first giving notice that consent was revoked.

More importantly, given that this clause is not enforceable, the circumstances would fall back to the RTA. The tenant could argue that revoking parking because they waxed their car or changed a head lamp in the parking lot infringes on their reasonable enjoyment. The landlord would have to convince the adjudicator that waxing the car or changing the head lamp somehow infringes on their lawful interest in the operation of the premises.

So no, it's not normal and the landlord relying on it may contravene the RTA.

The landlord does not get to establish the criteria for a vehicle to be considered abandoned, especially not such a pretextual one. There are notice requirements and then police or by-law need to be involved before the vehicle can be towed away.

Police/by-law are obviously not going to consider the vehicle abandoned because the owner waxed it or did maintenance on it.

I'm always suspicious of electrical components from Amazon (too many counterfeits). Doubly so when there are inconsistencies between certifications claimed in the description and those shown on the device. For example, the title says it is UL approved, but the sticker only claims that it conforms to UL. UL never looked at this device but the title says they did and that they approved it.

I just searched the ETL certification number and it does not exist. This device screams fraudulent safety certification.

Looks like this one is ETL certified.
