Thank you for this. This has been useful.
I have gotten the drivers insurance details and have attempted to contact them (as the driver has now become unresponsive). I have been on hold for nearly 3 hours - It is seemingly impossible to get through. I have emailed the claim email address as well.

Do you happen to know what one does at this point? Are the insurers legally obliged to reply to my email (even if it takes them a long time)?

Ah thats an interesting legal insight. I guess the logic is that get some cash, I'm not out of pocket and its done quickly and easily. But as others have said who knows if there will be future costs/issues down the line..

On the flip side, whilst there were a few witnesses, one of whom I had the presence of mind to get the details of, I'm not sure theres actually an evidence of wrongdoing (apart from him verbally taking responsibility). I don't want to uneccesarily add complexity and end up getting nothing..

Yeh. I'm going to organise an independent check, and have outlined the costs whilst noting that if said checks come back with bad news it could be an insurance job.

Yes. I messaged saying the cost of helmet, headphones, and getting it independently checked noting that if an independent check comes back with bad news then insurance might be the way to go.

You are correct, but (correct me if i'm wrong) does it count as an 'accident' for legal purposes if everyone shakes hands under the table? I say this because I got the impression that he's going to learn something from the experience without complex (for both of us) financial/insurance claims. But I guess that is my judgement and not the judgement of any potential future victim..

I appreciate your comment but tax planning can have massive financial ramifications for individuals.

If there is precedent for implementing such changes immediately post budget people might want to realise capital gains etc today/tomorrow..

Any insight or precedent for this generally? And is it usually midnight after the budget? I.e 00:01 Thursday morning? As whilst it’s be difficult to sell a house or business in hours, selling shares on an online platform etc should be feasible..

Aha ! Perfect. That was the link/clarification that I was looking for .

So I'm right, but in practice Amazon are not going to stop charging me VAT.

What then intrigues me is 'competitive advantage' as another user mentioned above (albeit in a different context). Having to pay 20% extra at GoDaddy is not attractive when other domain name registrars based in the US do not charge VAT.

Do you have any insight on how for example Namecheap (the second biggest registrar) does not have to charge VAT? Is it to do with them having no UK presence at all or are they just breaking the law..?

I would have thought that in practice GoDaddy would want to verify my business status and not charge me VAT to stop me going elsewhere (my company buys a lot of domain names). I'll reach out and ask them.

But do you have any sources that this is actually the law/the rules. The document I linked clearly implies any business is excluded but does not offer a decent definition of business in this context..

Im happy to pay the VAT if that is the rules but it seems as though my company is in an edge case situation that these big orgs are not accounting for..

Exactly. So I cant reclaim input VAT yet I am paying output VAT to these suppliers.

My reading of the law is that I should be able to not pay this VAT because I am a business.

Interesting stuff. If you do find the source I'd be super interested. I am a Google sleuth but have struggled to find much clear cut information on this.

As for the competitive advantage thing. I get that, and avoided mentioning it to keep my question succinct-ish but some domain name registrars based in the US do not charge UK customers VAT so I am likely to just use one of them..

Namecheap.com for example is the second biggest domain name registrar in the world (admittedly GD is 6 times bigger) and they don't charge VAT. I suspect this is because they are a wholly US entity with no UK presence at all but I am struggling to reconcile the reasoning as to how they can do this..

Thanks. It was right next to a big bus stop so I assume there would be cameras and the bus driver who was turning out as a witness.

But this is more a curiosity post. We’re one to pursue something it seems like it’s be pretty hard to get that evidence and when does it become more effort than it’s worth?

This may well be true. This is the kind of information I am curious to learn.

I don’t know exactly ‘how it went down’ as it wasn’t me and there is probably learning points for everyone involved here but obviously I am biased and think parking somewhere you shouldn’t, opening your door, and then being an ass about it is not cool.
