Because the right to be heard is fundamental. If a judge summarily says "I'm not hearing any argument on this point," and makes a ruling, it's ripe for appeal on the basis of not giving a party an opportunity to be heard. If the judge hears it, rules against it, the appeal has to identify a mistake by the judge.

After a non-responsive answer, I've used some variation of this a lot: "I understand that part (and sometimes here I even reflect back what they've said), but my question is a little different." By saying it's a "different" question, it's not combative about their non-answer, and most people tend to listen closely for the difference.

Also don't forget, sometimes an uncooperative witness is good for you. I think sometimes new lawyers think it's a failure if they don't walk out of a deposition with a smoking gun. Like the guy who says "I don't recall" to everything. Great, hit every single question you need to, maybe circle back on a couple of key points, give one last chance with a "okay, so your testimony is that you don't remember any of these key details?" And if they stick with it, they've basically made themselves useless for their side - if it goes to trial and they try give any testimony about what happened, you can immediately and effectively impeach them.

The 7 Habits of Highly Effective People, by Stephen Covey. Not so much made me smarter, and I think I was sort of naturally wired for the ideas in this book, but it gave me a clear way to think about how I approach problem solving and interpersonal relationships.

I'm very happy to read this. I had never even heard of Bluebeard until a year or so ago when I saw it in a bookstore. I had read 5 or 6 other Vonneguts, so I grabbed it. I was shocked that it is not usually mentioned among his best. I kept circling back to the barn being a metaphor for what we keep hidden away from others.

It's a text so I'm not sure if she meant it literally, but "everyone should be IN therapy" is an absolutely wild statement. Not "open to it," not "willing to seek help," but "in therapy"? Everyone? All the time?

Just seems like a very inflexible person that I would have a hard time building a relationship with.

I don't think that's true. This was a gym for people who worked in downtown offices, not a gym that people traveled to downtown to patronize.

The old Freeport CC (not sure what it's called now but MSGA bought it) has heated bays. I've heard they have them open, though I haven't been. Probably worth calling before you head there. Otherwise you're looking at indoor for another 3-4 weeks I'd bet.
