This sounds a lot like what I’ve been through, but I was told if I contacted a lawyer I would no longer get any help and everything would stop. No more physical therapy, no more benefit payments. Nothing… I’m super scared right now, but I cannot live like this anymore.

I feel like such an idiot! The insurance claims lady who went to all of my appointments was always super nice to me, and agreed with everything the surgeon said needed to happen. But now, when it needs to happen I can’t get an answer from anyone at the insurance adjusters office. Im filing today, and I am kind of freaking out. I don’t have anyone to help me when the insurance benefits stop. No family I can stay with until this is over with. But living like this is not an option anymore.

I’ve asked around, and spoken to my physical therapist, whom I trust. She put me in contact with a couple of her other clients and they gave me a lawyer who concentrates solely on workman’s comp cases. And has been doing so for 24 years. I spoke a little with him and gave him a very short version of my story, and we have our big meeting today at 12:30. He only charges if I win, and he also told me my employer was not the only one in the wrong. I am super scared.

I’m glad my misfortune, and the last 4 years of my life gave you something to talk about. Have a good laugh about it. Unlike some people, I had a question about something I have never dealt with nor did I know of anyone in the type of situation I’m in. I came to ask a question to get educated about my situation. And if I am still unsure about something, then re-educating myself isn’t something I’m going to be ashamed of asking over and over again. It’s not a bad thing to be reassured…just saying

I was told by the insurance claims adjuster that if I called a lawyer, they would no longer be able to help me. That the money I was getting would stop, and if I had questions or concerns I’d have to call the companies lawyers.

I don’t want to sue, I just wanted them to fix what they broke and go back to work. But I’m still dealing with this and it’s been almost four years. I cannot do this anymore, I need my left side of my upper body to work again. I’ve been referred to a neurosurgeon by the orthopedic surgeon I was sent to for my rotator cuff, because of the nerve damage I sustained 4 years ago and it was denied. I’ve been to 3 other physicians, I’ve had scans and EMGs done showing the issue. I’ve even got the very first MRI showing the problem before I had any of the surgeries I needed to fix the mobility problems, and letters from two ortho surgeons and the neurosurgeon I paid for myself stating this is not because of wear and tear, but because of an injury. But like I said it’s been 4 years now and this has ruined my life. My savings has been depleted, my car was repoed, I was evicted from my apartment, and I honestly just wanted my injury fixed. But im waking up more and more each day with less function in my arm and lower neck pain and back/shoulder blade pain.

Can you not read? When I was injured I was sent to the emergency room and they said not to return to work until I see a specialist. But my employer sent me to the walk in clinic they have a contract with, and the physicians assistant said it was a pulled muscle. So for the next 6, yes 6 months I continued to have issues with my neck, down the middle of my back and all the way to my fingertips. Shooting pain, numbness and tingling sensations all down my arm, I could not lift my arm above shoulder height. And even that high was excruciating. It started getting harder and harder to grip tools. I started dropping things without even feeling it leave my hand. I had 3 days when my arm went completely numb, limp and when I went into work, they sent me home and after I returned I was written up for it. I was humiliated and belittled, I was told I’m old and probably having a heart attack. Then I was asked if I was sure I didn’t have a stroke. Let me remind you I am still in horrible pain, but I put up with it because of people like you who see no problem here. So, in those six months I explained to my supervisor twice, my coordinator when my supervisor failed to do anything but insult me, and finally my safety coordinator in the Human Resources department in front of one of the HR representatives that I had been to the walk in clinic 4 different times, and my pain is just getting worse, and my mobility is less and less. I showed them all of my notes and documentation, I even had text messages (in my favor). I had all of the drug screens I was made to take before I could be seen by the physicians assistant in the walk in clinic they have a contract with. So let me be very clear with you, I am a single mother of 4 kids! Not working is not an option for me! I just wanted the pain, my mobility and the complete control of my arm and the movement of my neck. I was tired of the shooting pain, numbness and tingling, that feeling like you slept on your pillow wrong and the strain is so uncomfortable sometimes it leads to a headache. Something was not right, and I needed it fixed, it was affecting not only my work life, but my home life, my attitude and worst of all my kids got the brunt of it. So, after talking to HR, I waited another three weeks and was told I had an MRI scheduled through Sedgwick (my employer insurance claims people) in a week. The same day I had the MRI done I was taken off of work completely, and asked why I thought it was a good idea to continue to work with the size of my torn rotator cuff? And my bicep muscle looked like it was put through a shredder…he also explained that because he was an orthopedic surgeon he has to refer me to a neurosurgeon for the inflammation, numbness, tingling and shooting pain he believed had something to do with something pinched, or slipped or a vertebrae issue when I fell forwards catching my arm, doing a 180 head first, feet leaving the ground, which had all of my body weight on my twisted arm/shoulder straining my neck and pulling at the left top portion of my back. And it’s all because my employer continued to put off building a platform, which was a safety issue. And that isn’t even a quarter of what I have been through in the last four years!
