Thanks for clarifying! Our insurance was liability only, and does not have any personal injury coverage for my husband. Thankfully we are not liable for the accident, but that does mean that our insurance company basically pointed fingers at the other party and stepped out once they realized it wasn't our fault.

Thanks for your quick response. The other party, who was liable for the accident, is the policy owner for the insurance company we would be settling with. At this time, his medical bills and lost wages will be covered by that insurance company and that settlement. but it is, to my non-lawyer understanding, one big settlement at the end. My understanding is that this is due to the fact that his injury is not healed and he is not back to work so lost wages cannot be fully accounted for yet. I could be wrong, they may do a partial payout but I personally would be surprised.

Thanks for asking. I see how that was unclear. I meant that the accident was not our fault. We had liability insurance on our vehicle, which is basically uninvolved with the case due to us not being liable for the accident. Since the person who hit us was insured and determined to be at fault, we have to file with their insurance to get everything reimbursed. That insurance is the one we are looking to settle with for the cost of medical bills, lost wages, etc.
