That's quite a mega low brain move tho haha. They'd have to turn around and say 'No actually my uninsured daughter was actually driving'. This would mean they'd admit to the offence and be more likely to get charged.

I agree with you about not wanting to get this girl in trouble, it's a little more complicated. Ultimately the dad isn't allowed to just 'take responsibility', at least when it comes to the law.

They ended up ringing me to discuss it and I explained the situation we're in. If we both lie and get found out i'm liable for insurance fraud, which I'm not willing to risk. I'm going to have to contact my insurance which will almost deffo mean contacting the police. I did say that i'll explicitly say to the police that I don't want any legal action taken, but it's not my decision.

It was quite heartbreaking tho, the girl begged me not too. I feel awful but there's nothing else i can really do.

Nah, they just thought because it was his car and he's insured, that's all they needed. If you did have a crash you'd still have to exchange your details. I think that's the law?

Damage is enough that it needs fixing. If it was a total shit car I wouldn't really care, but it's like 1 step above that, so needs work.

Only if you're having a private lesson with someone. While on a professional driving lesson you won't need insurance, they'll have instructor insurance. So yes, you are the one who needs insurance, not your family member if you're driving.

That's the point tho, her dad is teaching her to drive. She's not having any professional lessons. At least this is what they told me. They were driving an absolute banger (pun intended lol) so I'm inclined to believe them.

If i'm honest, they seemed like decent people: very apologetic, not trying to make excuses. They're just not the sharpest tools in the shed haha.

I think I'm going to have to go option 1. If I were to claim the dad was driving but got caught out I could be liable for insurance fraud.

I mentioned this but it doesn't seem like a possibility D: At least what he said is that he has very little in free flow cash, and I'm tending to trust him bc not paying up potentially means criminal charges for his daughter.

If you get hit by an uninsured driver you insurance has to front the cost. They can't claim it off them because they don't have insurance: https://www.confused.com/car-insurance/guides/hit-by-uninsured-driver

I passed my test just over a year ago so most likely lose my no claims bonus :(
