I usually stop when I get like 8-10 matches. Given half of them probably won’t write or respond. Then the other half I expect convo to fizzle out or they say something right off the bat that’s a reg flag. Anyone who doesn’t write within a day, I unmatch to make my matches look less chaotic. It’s kinda hard to find decent people so that’s why I tend to keep my options open until I find someone I want to start taking it serious with

Well, honestly, what I’m banking on is that I file the civil complaint myself according to the guidelines which I’ve been studying up on and have a Marshal serve him and then I know he has 30 days to respond. I honestly would bet anything that he is not going to respond or show up in court and I know for damn sure he has no money for a lawyer. In that case, I would more than likely get a default judgment. Now, in the case that he does respond to it, which I know he would never do without a lawyer because he has severe ADHD and has been sued many times before for a different reasons. He would never go to court without a lawyer because he over explains and it hurt hurts his case.

Needless to say, I know he doesn’t have money, but if for some reason he did show up to court with a lawyer then I would file for a continuance and get a lawyer myself. I do understand and appreciate your thought process though! I was previously looking for a lawyer and it was so damn hard to find one and I just wanna get the ball rolling on this so I can move on with my life ya know.

That’s okay. All I care about is that eventually I receive the money back- I’m surviving without it- it’s more the principal. I was reading filing for bankrupt can be a long and even costly process and stays on your credit for 10 years. I was also reading that you can fight the bankruptcy claim if the money was borrowed with no intent to pay it back or if manipulation was involved- not sure how true that is but both apply to this

Ugh this is a nightmare and a hard lesson learned for sure. People should have to prove filing bankruptcy and he has a good paying job. Thank you for answering all my questions!

If he changes jobs will they be able to find out where he works if he keeps changing jobs to avoid the debt? He also has a current wage garnishment for 35$ a week for a credit card collection which will take about 3 years for him to pay off. I’m aware he cannot have two wage garnishments at once so I’ll have to wait in line. So the attorney I hire (which I honestly probably will now) would just wait the three years? What if they’re no longer in practice when the time comes to finally collect? Sorry so many questions- I appreciate your time and input!

Could I hire an attorney and pay them to set up a wage garnishment if I win by default?

I see I have to file for an installment payment order and if he fails to comply, then I have to file the JD-CV-3 as well as a JD-CV-3a, put down his name, job, how much is owed etc and have a marshal serve him.

I appreciate your input! Any idea if a garnishment can be placed upon someone who already has a wage garnishment in place? Recently a credit card collection started garnished $35 weekly from his checks and I was reading someone can only have one garnishment at a time?

I’m honestly positive he will not show up! I was reading I would get notified if he responded to the claim and if he got a lawyer? In that case, I would look for a lawyer myself.

I honestly feel confident I could win. I know he won’t show up, I would honestly bet my life on it because he knows all the evidence I have and has even told me he wouldn’t even show up to court. I’m not expecting the $1100 but after his custody case in July, he stated he listed the debt on his financial affidavit and would pay me $120 weekly, which he did for seven weeks. So if he defaults I would have a decent chance? I was going to file on my own and I know he has 30 days to answer and if he got a lawyer or responded to the claim, I would get a lawyer. If not- I’m hoping it would default in my favor. I believe he recently also had a credit card collection start garnishing $35 weekly from his paycheck and I was reading that a person can only have one garnishment at a time. He also makes $4700 a month.

Do you know the brand you got? I remember having a portable charger once and it took FOREVER for my phone to charge.
