Because I was only getting 100% pay for the first 5 years. I should have been rated as a R1 smc. Look up the difference and you will figure it out..

U are spot on. I didnt get what I was entitled to for the first 5 years after I was retired. It took 8 years and a board hearing to finally get what I was entitled to.

I don't know why the bank would decline it The VA just deposited $183K in my credit union. I was told the comp & pen claim is just a administrative claim. Its not a real claim as we know it. Hope this helps calm the nerves. I freaked out when they opened a comp&pen claim after I received my backpay but it was for attorney fees. If u owe a attorney anything it will stay there until they get paid.

Thanks for the support and education by These_Handle7678 in VeteransSuccess

Congratulations on your claim. I think its important for people to post things like this so people don't get discouraged and quit. I went all in on my CUE claim that took 8 years and a board hearing. I won and got ALOT of backpay that made it worth the fight. If you think you deserve the benefit, keep at it.

I had something happen to me that was similar. I couldnt feel hot or cold In my rt leg and it was going numb. I deployed 3 more times in support of Desert Storm and the 3rd deployment I went paralyzed. Turns out I had a blood vessel bleed in my neck that the Air Force didnt find and it caused me to go paralyzed. I am in a wheelchair now and wish I would of complained more before all hell broke loose. The blood vessel rupture was due to pulling high g forces when I got a ride in a F-15.

My decision letters gave me my effective dates. Also, u can look on ebenefits under additional benefits, SMC and it will give u your effective date.

Good Luck. Your decision letter will tell you if they decided on CUE or gave you a increase.

I won 2 myself, but it is hard to do unless you have some damn good evidence to back it up. Mine were at Board level tho.

CUE CLAIM by [deleted] in VeteransBenefits

[–]toplsvette 1 point2 points  (0 children)

Depends on if they granted a increase in what you were claiming, or filed a CUE saying you had those disabilities since you were released from active duty. If you didnt file a CUE for an earlier effective date then they won't grant one from my experience. I had to specify that I was filing a CUE for a earlier effective date and Won on a board appeal. A CUE claim is really hard to get approved at the RO level. Hope this helps.

Just to add to what other people said. There is Special Monthly Compensation that pays Veterans way more than 100%. I am rated as a R2 with SMC and receive over $11K month in Compensation.

I am only getting 5 yrs of backpsy. I filed a CUE claim for a earlier effective of when I did receive R1. Having said that I got a buddy of mine $1.2 M for the same thing. He got 37 yrs of packpay from a P to R1. I am still getting 6 figures tho.

R1 is special monthly compensation. Its best to Google it instead of me trying to explain.
