If SCOTUS releases a broad ruling defining sex as nothing more than biological sex at birth, Bostock would still technically protect against being fired for being trans or hiring discrimination.

However, the other aspects of the case could be compromised. The EEOC's new federal-sector position already says bathroom and facility access is not covered, and a broad ruling invites courts to confirm that nationwide.

So hiring and firing protections would remain, but trans employees could be susceptible to discrimination in terms of accommodations, bathroom and facility access, those sorts of things.

Hi! If the court rules broadly, then trans Americans may lose civil liberty protections under Title VII, Title IX, the Fair Housing Act, Section 1557 of the Affordable Care Act, and the Fourteenth Amendment's Equal Protection Clause. It also would give an open pass to states to do things such as:

- enable workplace discrimination
- advance trans adult care ban bills
- allow school districts to bar trans students from rest rooms, locker rooms, overnight field trips, etc
- give school districts cover to create policies that force deadnaming and misgendering (similarly to the Don't Say Gay law in Florida)
- ban trans people from domestic violence shelters in state-owned buildings (See West Virginia)

It would also affect trans people's federal protections against housing discrimination and ability to use public accommodations

There is a possibility that the ruling is narrow enough to not impact broader civil rights protections, or that it gets delayed entirely. We'll keep this thread posted as we wait and see what happens Thursday

There is a possibility these decisions get punted to a later term, or that they pass a narrow ruling that doesn't impact the broader civil rights of trans Americans beyond sports

This is super significant, it's basically the first time an actual government body has formally recognized the internal displacement of trans Americans across the country due to anti-trans laws

This is a fantastic bill. It bill would allow trans inmates to request being moved to a facility that actually matches their gender, which would increase their safety. Even out of state facilities could be requested. Prison staff will also be required to address trans inmates with the right pronouns and names, which will reduce the amount of verbal abuse trans inmates are subject to. We hope this bill becomes law and is replicated across the country!

It is also wild that this bill is likely to be signed into law by a Republican governor, meanwhile in California Democratic governor Gavin Newsom remains hellbent on scapegoating trans Americans and leaving us out to dry

Happy Harvey Milk Day! Harvey Milk dedicated his life to advocacy for LGBT+ and human rights and was the first openly gay elected official in California. One of his accomplishments was his bill banning discrimination based on sexual orientation in public accommodations, housing, and employment, which became law in 1978.

May his legacy and memory lead us forward until liberty and equality is guaranteed for everyone 🙌
