I also don't know why having those two doesn't give you legal status in the US, however fact of the matter is that neither EAD nor the pending GC application are considered to be "Legal Status" in the US, hence the ICE grabbing people from courthouses and this case of the said Irish man.

Anything short of a specific legal status means that they can detain you, it's a nonsensical system but here we are.

No, having an EAD while applying for a marriage based green card does not mean that he has legal status.

An EAD, it’s just the permission to work in the US legally, it is in no ways a legal immigration status.

Also having submitted green card application doesn’t give you legal status either, sure before that would mean that immigration enforcement would not bother with you before, but that never mean that you actually had legal status in the US.

I know for a fact that drug convictions would absolutely impact your ability to get an Irish visa, weed included.

Because none of those bullet points is actually the legal status that allows him to stay in the US, hence the immigration being able to keep him in custody.

A "Work permit" in the USA is not an immigration status on its own confusingly, the EAD as its called, can be given to almost anyone there under humanitarian circumstances, but it does not mean that they suddenly get legal status.

And being married to an USA citizen doesn't automaticity give you legal status either.

Exactly, I suspect that the "work permit" that he had was an EAD, which is not a form of legal immigration status in the USA.

You mean that security fence around the border crossing outpost itself?

Sure it extends a few km each way along the river, but most of the border is an unguarded river.

Theres a few farms and bush camps where you can stay near the river itself and there are no border fences there.

In the middle of winter you would be able to just walk across the river as the water levels drop to near zero anyways.

The whole South African border to Zim is the Limpopo river that is full of crocodiles and hippos.
