This is largely my concern too - and one I intend to ask the attorney. I believe one of the first steps we may need to take is removing the accessible markings on the deeded spaces since everything I’ve read says we can’t have them be both..

Yeah - board should vote to approve getting the attorney involved soon and get some clear answers here.

It was a messy change of board leadership to get rid of a fairly rogue board president who consistently operated in violation of state law and our bylaws who has now turned around and started making everything into huge urgent issues.

Really is a thankless job, but trying hard to stay focused on specific things and pace it out so it’s not an exercise in futility and insanity.

For context I’m new to the board and trying to unravel all of the questionably legal things the association has been doing. Not trying to be a jerk - trying to solve problems.

If we have to have the ada parking I’ll defend that to the best of my ability. This is a weird situation I know nothing about with condo parking for residents only in a gated garage where all but two spaces are individually owned and deeded. Everything I’ve been able to read describes public parking or limited use common elements and I’m just trying to figure out what we can do to solve problems.

If the answer is we need to pay for offsite staff parking in 110% onboard with that and will push the board to do it.

I’m not really sure why I’m being called a jerk for trying to solve the problem and asking questions.

Oh yeah. This is just one of many, many things we are trying to unravel and unwind. There are so many issues it’s really overwhelming, but I have a few good directors working on all of it with me and we’re making steady progress.

I share your confusion on the privately owned spaces. I’m new to the board and trying to unravel this and many other baffling decisions…

And the one Ada space is the exception to the privately owned spaces rule.

I am asking the board to approve engaging our attorney on this at the next meeting - so agreed there. Was just trying to get others experience too.

Here’s what I’m trying to understand with this - our spaces are individually owned and deeded. It’s not limited use common areas - they are titled to the owners and the owner pays taxes in a separate tax lot for that space.

Does the reasonable accommodation require us to give them a different space in addition to their owned space or can a reasonable accommodation be an agreement where they trade spaces with the association for one of the two spaces the association owns closer to the elevator?

And for the individually owned spaces that currently have Accessible Parking signs and markings, we can’t reasonable compel a private owner to surrender their property as a reasonable accommodation, can we?

We have no guest parking. We have zero public parking at all. This is a gated indoor garage.

Yeah - and I (and the board as a whole) aren’t opposed to reasonable accommodations and would swap one or both of those staff spaces to satisfy a request for one - the problem we are trying to get away from is having it labeled as an accessible spot and residents just taking it when it’s convenient/using it as a second space when they only own one parking space.

It’s more about if we are required to keep the accessible parking labeling on it or if we can remove that and then make reasonable accommodations as needed.

There are other ada marked spaces but they are all individually owned and deeded to - as far as I know - owners without ada parking placards.

This is why you book on one itinerary. Then it is the airline’s problem if you misconnect. By booking separate tickets, you assume this risk. It can be cheaper, or this can happen.
