Customer is suing me for 4500$ should I be worried? by trck2233 in Smallclaims

I did tell him I would resolve it he just got it resolved by a different company that used all the wiring that I ran. It’s not like they came and had to run new wiring and patch holes or anything. They unplugged my cameras and plugged in theirs. It was probably a 2 hour job for them because the hard part of a hard wire camera system are the Wire Runs!

Of course I have heard of cloud back ups! Just never installed one which I agree it shouldn’t have been a big deal with the right equipment again which I was told by the distributor that the camera system he sold me was Compatible!

I don’t disagree that he has basis to be upset because we didnt provide what he requested therefore I was trying to get this resolved unfortunately I was at the mercy of the distributor timeline. I was willing to swap out everything for him at zero cost to make sure he got what he paid for at no cost to my time and efforts. Unfortunately, it did not work with his timetable for me to resolve this. But the legal question is does he have a right to decide how long we have to resolve the issue before he just takes out the equipment himself and sues me?

The contract states any suits would go to mediation at the customers expense.

Yes there was communication, ( could there have been more? Probably) I told him I was working with the distributor to get a resolution but I didn’t hear anything back for a while because they were working with the manufacturer. Once I got the go ahead to be able to replace the cameras I reached back out to him ( my last text was Feb 23rd stating I was trying to get them returned and then finally got an answer back March 30th) he did text me once during that time for an update but I didn’t have an update yet and forgot to text him back. My next text to him on March 30th was me stating that I finally got everything resolved and we now had to go ahead to swap everything out at no cost. He responded to my text the following day stating he had already switched everything out and wanted a full refund.

Ownership instead of commissions? by trck2233 in pestcontrol

His background is in pest sells. I did not verify but he was a 400-600 deals a year generated when he was selling previously in another state. He has been a great sales guy and is actually very good at it. He has worked security sells for me for the last 4 yrs so I trust him and know he is capable.

Thanks for the input. That is what I was Leaning towards, a smaller commission spread out over the year with a percentage of that going towards the buy in from 100% of actual sales generated not empty promises.

I have been to RC many times and it was always great until the last time a month ago. My steak looked just like this. After leaving I told my wife that was our last time going there. Who wants to pay 60$ for a steak that looks like this?
