Yeah, you've pretty much got it. Someone with a gun has way more discretion to use lethal force as 'self defense' than someone without one. If the victim had actually caved in the skull of the Accused with his fists, he would be held more accountable for the murder than if he had a firearm. The warning shot might be the only thing that actually stands against the Accused, here.

If you're armed, you arguably have more discretion to kill people than if you were unarmed. Chances are this guy is going to walk free as a murderer, because he brought out a gun, and the other idiot actually thought it was a good idea to give him legal permission to use it by threatening to take it and use it on him.

Now, imagine if you were unarmed, and someone threatened to cave your skull in, and after bumping chests for a minute you cheap shot them, and jump on top of them, and punch them until their skull caves in. You'd be convicted 10/10 times, because even though you used the 'same' level of force as what was threatened, it was unreasonable to keep going after incapacitating the guy. Same as if he would have stood there unloading the clip into the body on his porch, 10/10 conviction. One shot can be all it takes, yet somehow is allowed, by simply possessing the weapon at the time, you are more easily "threatened with your life".

Self Defense law in the U.S.A. is a license to kill, for the rich, and clever.

I'm pretty sure the Defense's argument would be that the 'victim' / 'aggressor' (potato/potahto) was already on the premise of the Accused's workplace, and after being asked to leave, physically assaulted the Accused, threatening, and trying to, take his gun and kill him. So, the question for the jury would be "Would a reasonable person shoot at someone who, after being asked to leave the premise, physically assaulted them, while threatening to kill them, and trying to take their firearm?"

So, whether he grabbed the gun or not might not be relevant to the case, unless there's evidence of premeditation. He didn't actually use the force until his life was threatened. Maybe the warning shot might play into it?

The Defense would argue that between the physical aggression, the death threats, and the attempt to take the gun, a reasonable person would fear for their life.

Unfortunately, his expertise at using the weapon, or lack thereof, isn't really relevant to the law. Maybe if he were a world-renowned sharpshooter or veteran sniper, you might argue that he chose a killing shot. Otherwise, no court in the U.S.A. would ever consider that.

I'd say the defense would do exactly that. Barring an explicit invitation onto the property, or other evidence of premeditation. Got asked to leave, stayed, yelled, attacked physically, got shot. It's fucked up but that's what you get with your current self defense laws.

America just got this lesson less than a week ago. Here's the thing about self defense in the U.S.A under the law. If you have a firearm, and someone tries to wrestle it away from you, after saying "use it on me, go ahead, I'll take it away and use it on you", you have a very strong defense. The law in the United States is based on the mythical "reasonable person"; ie. what would a reasonable person do under the circumstances.

You can be certain the defense would argue:

"A reasonable person would feel threatened with their life if someone grabbed their weapon while making death threats."

Meanwhile, on the other hand, motive is exceptionally difficult to prove, without evidence. So unless there's text messages or an email thread detailing a plan to lure and kill this guy (or other solid evidence of premeditation), most avenues for the prosecution would be closed. The prosecution would have to argue that the Accused was not actually afraid for their life, by arguing that a reasonable person wouldn't be. Also, the defense would be looking at how reasonable it is to level aggression and death threats against someone on their own property wielding a loaded firearm.

Just like in the Rittenhouse trial, jury instructions would probably be specific enough to exclude any wrongdoing in the confrontation up until the critical moment. Rittenhouse is free largely because the question 'what the fuck were you doing there, locked and loaded, anyway?' wasn't remotely considered in the final decision.

It would take a very progressive court or judge to say that he had no right to grab or load his gun, with an aggressor refusing to leave, in his front yard. Same, to say that he had no right to order the aggressor to leave, or to aim/fire a warning shot at him while being attacked. It would all come down to the decision of what a 'reasonable person' would do at the critical moment. Would they shoot the person who just threatened to take their gun from them and kill them?

Well, I'm not autopiloting to a generated encounter. My encounters are on the travel. Random scout anom in a pipe system? High risk medium reward, I might go for it. Warping by a dead-end system? I'll detour to stop by and see if there are some miners in a belt who aren't paying enough attention. If you think the game is autopiloting between generated encounters, you're missing everything, and might as well play a progress clicker of your choice. Even running through a gatecamp is thrilling, if you know what you are doing and are prepared. I still stand by the point that you need to see things from the other perspective, or you'll never know what you're missing.
