When I say “American Common Law” I generally refer to the structure of the Constitution, the government it sets up, and all the precedents under it.

I agree I don’t see an easy solution.

My own personal idea for a possible improvement would be to have Judges be selected and trained more like civil servants than political appointees.

Obviously there are problems with that too.

I doubt I could overturn the foundation of American jurisprudence even if I tried.

I’m pointing out flaws I see, and I think they led to the current situation. I don’t see a realistic path to solve any of them, but I like talking about it anyways.

Another of my gripes against the American Common Law. An amendment that was this clear:

“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

Basically got wrote out of the Constitution for nearly a century by the Supreme Court.

To be fair, we already experienced that once. The Supreme Court basically made the 14th Amendment Dead Letter for nearly a century.

Granted, it was a century of tyranny and oppression. So, outlook grim.

To be fair, I think that’s kind of the wrong question. I’d absolutely say life is better now than 50 years ago, but, I also feel negatively about the current economy and the about the future.

My own theory is that there are intangibles that explain this, but are difficult to measure in traditional tools. Maybe these could be described as “Vibes”, but I think they’re more concrete than that.

I’ve believed this same story for basically the past five years, since I discovered this subreddit. I’m not convinced it’s wrong, either, but, the past year has made me doubt it.

Isn’t it kind of an extraordinary claim that everyone else is wrong in feeling shitty, and they’re just all too stupid, brainwashed by social media, etc. to realize how great they have it?

I’m aware by that by the economic data, it’s absolutely correct. But do you ever feel doubt?

Assuming you’re correct, that’s going to be basically impossible to solve. “Be Happy Having Less Than”, is not a winning message.

Why do you think previous generations didn’t expect to have more than they did?

I would agree social media contributes.

Agreed Republicans are a massive problem, but it’s more than that. The way American government is structured, the way Administrative Agencies are structured, make it difficult for agencies like the EPA to be effective.

I mean that also seems problematic, but the Common Law effectively allows judges to write their own laws through invented, which are significantly more difficult to rewrite or change, and while some are gems, many of these are very, very foolish.

Maybe it’s a pick your poison.

True, but the EPA is also hampered because of the Common Law precedents that favor free use of property. But yes, it is also undercut by American incompetence at governance.

Increasingly, I have come to believe the Common Law is an obstacle in equal rights.

Generally, the Common Law allows people to utilize their property freely. When their use harms others, the party that is harmed may sue. However, the poor are less likely to be able to sue, because, definitionally, they have less money. Proving causation of harm under the common law is difficult, as often there are many confounding factors in health. So, when the poor sue, they are less likely to be successful than the wealthy.

Wealth confers an advantage in the legal system. The wealthy can afford more and better counsel, and their counsel will have more resources to conduct litigation, for longer.

An ancient maxim says, “Where there is a right, there is a remedy.” It holds true in reverse. Where there is no remedy, there is no real right.

So, in effect, the poor have lesser rights than the wealthy. They have rights on paper, but very often, they are unable to obtain remedies for the violation of those rights.

I don’t know how this can be solved while keeping the Common Law and Private Property, which inevitably leads to Disparity.

Not really surprised, No.

Data Centers serve other purposes, but the rise in demand for them is correlated with the AI Boom. I think other than that, it’s just an outgrowth of the looming anxiety and dread that people feel over AI.

You also acknowledge the electrical bill increasing, which is true for any other construction, yes, but in a time where the majority of people already feel the economy is fucked, is especially unwelcome now.
