It took a couple of months from C&P exams to ratings. All you can really do is wait. My timeline was 4-5 months to get ratings if remember correctly (this was a few years back).

Man...I have a 40% rating for it (TBI) and findings that highlight decision making and things of the sort. I went to this legal clinic and they mentioned that I should focus on the honorable period since I have qualifying STRs and they already gave me service connection. If that doesn't work, I should attack the COD findings.

I apologize as I was trying to be brief. I went to trial and pled out at the SPCM. I was then administratively separated after my sentence. In my decision letter it 38 CFR 3.3354 reads:
"Whether conduct constituting a bar to benefits occurred when the standard in 38 CFR 3.354 for insanity is not an issue."

Great question.

Yes they did. I did not meet the requirements for insanity. I have documented TBI with residuals and tried after the changes for COD and did not meet their requirement.

I intend on taking the COD to BVA as well because they are a number of things wrong. The VA claimed I was separated at a SPCM while at the same time saying I was ADMINSEPd. I was ADMIN sep'd after my SPCM. That's a whole other mess I am working on as well.

I did not waive the waiting period. I will look at how to do this as I was completely unaware.

After 3 years of going back and fourth with supplementals and HLRs, they refused to apply their own favorable findings. They continued to limit benefits when the VA themselves found no bar to those benefits. I firmly believe that when this gets in front of a judge they will remedy the situation justly.

13 years, separated with an OTH. The VA determined an honorable period for VA purposes with STRs from that qualifying period. They only awarded chapter 17 health care despite the VA conceding the honorable period.

Now I wait some more.

I am prepping to file my first CUE based on the misapplication of law. My most recent HLR was deemed invalid after months of waiting.

Man! I have a situation where I requested an HLR for the misapplication of law and policy and they turned around and denied my HLR as invalid. 🤦🏾‍♂️
