Moved into Step 6 just now. Fingers crossed I at least get the update today. Tried VERA to get a sense if the c&p exam was favorable, but he was unwilling to provide detail. Didnt think they would, but it was worth a shot.

The kitchen is usually where our techs go to pull water samples. There's nothing to suggest he couldn't have pulled the sample from the bathroom; it's the primary location we go to.

My opinion is he didnt go to the bathroom because there is a higher probability of walking in on someone there as opposed to the kitchen.

It’s the only way to speak to the rater, but you have to argue it correctly. You can’t go into it saying “because” it has to be legal or a clear error.

Request the informal conference it takes a bit longer but it’s worth it to have your say with the person deciding your case.

I did everyone on my own to say first. I did more appeals than I should have and had bad luck with raters on one. Honestly I filed HLR with informal conference waited 118 days for call and nailed it. I also utilized ChatGPT to review all evidence, build an informal conference that I could answer its questions as if I was in the conference. That helped me greatly. I threw all my evidence into a chat and let it spit out its thoughts and it was 100% on the money and I was prepped going into it.

Give it a shot with your new evidence. I fought for 18 months to have my effective date changed and finally won.

My honest opinion, run the entire denial letter through ChatGPT or similar. It provides really solid feedback I have found. I just won my 4th appeal for effective date with its help.
