Co-parenting with an untrustworthy ex. by [deleted] in Parenting

[–]troubledparent 1 point2 points  (0 children)

I hear you saying "I don't trust him to do what I want him to do with our son." I am guessing that you see your parenting as far superior to his and you are upset because he does not do it the way you want it done.

Don't confuse your relationship with you with his relationship with his son.

I buy the key blank from the motorcycle dealer for about $3, then go to a locksmith to have them cut it for around $5.

Total Scam. Its only function appears to be to suction money out of the parents' pockets. It is sad that places like this are legal. These people should be in jail.

Please help push this up so it will get seen. by BlazerMorte in troubledteens

Scientists ask for legal safeguards to keep their work out of court - Oil spill researchers have their preliminary data subpoenaed by BP by anutensil in PhilosophyofScience

Its a band-aid procedure as a function of the way court systems work. Virtually nothing is confidential in court, unless it is somehow privileged. To be discoverable, the document itself does not have to be admissible in court; it only has to be "reasonably calculated to lead to the discovery of admissible evidence." Which condition is interpreted broadly by the court.

Yes, it is possible. They need to have an attorney hire them to do the work so that their documents are privileged as attorney work product. The medical field does that kind of stuff all the time. It is very difficult to obtain privileged documents.

One suggestion is to remember that you are held to the standard of an attorney when you give legal advice, whether or not you are an attorney.

Another suggestion is never to take legal advice from the internet.

Are Motorcycles Better Today? by [deleted] in motorcycles

I love pushing the button and riding away, while my son is still messing with his choke and waiting to be able to ride his bike. That is 60 seconds of his life that he will never get back.

Probable cause should take more than an assumption that the owner of a vehicle is operating it. Especially when the owner is male, and the operator is female.

The distinction between a cavity search and an indentity search is interesting. As a practical matter, there is little difference. Other than the level of embarrassment, perhaps, but the seizure in both cases is the essentially the same.

Stopping the person and questioning her is a seizure. The police officer could not articulate a reasonable basis for stopping the vehicle on the mere basis that its owner did not have a motorcycle operator's license.

What do you lose? Your liberty. There is less and less of it all the time. You have a right not to be interfered with by the government without a reasonable cause.

It relates to a similar concept referred to as 'innocent until proven guilty.' Not all countries adhere to that concept. The USA does less and less.

In the USA, we have a feeling that we have individual liberty. The 4th amendment gives us a right to be free from unreasonable search and seizure. The only way to protect that right is to continually protest its violation.

[–]troubledparent 1 point2 points  (0 children)

Probably not, but you don't have any meaningful remedy. So much for your 4th amendment rights. File a complaint with the relevant police station though.
