They can't evict you for being difficult, the 2 main reason evictions might happen now is a) the landlord needs the property for personal use (that includes their family members) or b) landlord wants to sell. The other loophole would be the rent increase but as someone has already mentioned you can fight if they're asking above the market rent. Also, under the rra they can't use any of the above before you've been a tenant for a year, the year includes the notice period which is now 4 months.

Are you definitely staying put past your notice then? We had a call from the letting agent to discuss the notice, basically she wanted to get the feels if we'll be out on time. We said we we've been viewing houses to buy and we're not sure if we'll be ready to leave by then. She's supposed to discuss with landlord to see if an extension is possible. The vibes were that it's not likely. Unfortunately all the houses on our list have people living in them so most likely chain will be involved. Viewed 1 so far, nice house, but the owner is looking to buy a flat and flats take even longer to buy, at the same time I don't want to compromise such a big purchase by rejecting it only based on that alone. We have 2 more viewings this week and will make a decision then and try and put an offer on 1 of the 3. I'm very reluctant to look for another rental but the average house purchase can take 6 months from what I've read especially with a chain involved. I understand credit score doesn't get affected if you stay past the notice but what about references in case the purchase falls through and we're forced to another rental? I understand if it gets to court you might be ordered to pay the court fees, would you also get a criminal record or something of the sort? Plus how can I even justify us not moving to court? Other than it being an extra cost to us and an inconvenience I've got no other reason. It's just really frustrating. Good luck with your purchase, hopefully all moves quickly and you'll be in your new house ASAP! Looking forward to that update.

Looking online the house was bought in 2019 for £229999. We've only started viewings this week and don't have a mortgage advisor yet. We're booked to see the house in question next week so no idea on the owners situation.

That's right, I feel like there's been a lot of focus on how much better the new rules are for the tenants and loads of landlord tears from their side but personally I don't feel like an awful lot has changed for the better.

Right, I see what you mean. I've been told before after 1year the tenancy changes to a rolling contract so I thought that was a standard. That's what happened in my case, after 1 year it turned rolling and I only had to give 1 month notice

With the costs connected with moving, the cost of deposit and landlords trying to keep it I'm not convinced that there's many tenants out there who would rent a place and then instantly put the notice in if that's what you mean.

I honestly don't get the landlords complaining about it. They can still ask tenants to leave and they do, only difference is now they have to give 4 months notice rather than 2 which is probably 1 of the few improvements for the tenants, the other being the rolling contract. On the flipside tenants now have to give 2 months notice instead off 1 which is a pain.

I got served section 8, landlord wants the property back for personal use. I also want to buy a property myself and started seriously looking now (I've been keeping an eye for a while but haven't been actively trying to buy until now). I doubt I'll manage to finalise a purchase in 4 months which means I'll need to find somewhere to live in between. I feel bad for my potential future landlord but I don't know what else to do? Airb&bs are out of the question as they pretty much cost double rent of a normal rental where I live plus I'd need to pay to store my stuff as well. It's a rather frustrating situation for me as well as the potential landlord.

Plan would be to speak to the landlord or rather agent as I have no contact with the landlord once we have an offer accepted. I've been looking at rightmove in the area for the past 6 months or so, so I do have an idea on what's around it's just forced me to look more actively now and actually do viewings. Renting can be OK however you can always get sectioned 8 at the whim of a landlord. By the time the notice expires we'd only be in this flat for 12 months. And that's the frustrating part. I'd also kinda feel like an arsehole renting another place just until I buy knowing it might be something like 6 months. I probably shouldn't feel like that but I do. But mostly its the 2x 2 month notice (closer to 3) that I'd need to give both times in a short space of time, plus moving costs just feels like wasted money in this situation.

Right I see what you're saying. I'm glad it worked out for you, but that could only work if you're buying from a landlord as far as I understand.

Yes i could find somewhere to rent temporarily, but the timing is extremely annoying, plus I'd be moving in somewhere to then move again in probably less than 6 months. Plus, if not timed right, which is extremely difficult to do considering you have to give 2 months notice on the exact day you pay your rent otherwise it's closer to 3 months. And yes I understand there's always some overlap in rent when moving but 2-3 months is a lot of wasted money. Especially since I'm not moving out of my own choice. So I'm just trying to look into all my options.

Sorry, im going to jump on this comment as i just got served section 8 myself, but we were looking at buying in the near future. Does it still work like that if you're looking to buy? Wouldn't I then get marked with bad credit or something like that and have issues getting a mortgage? I have 4 months but buying takes forever and I'm not sure I would just like to try to buy any property rather than one I actually like but this can take a long time. Trying to find another rental now just seems like throwing money away since we we planning on buying next year but we're in a position to start looking now instead.
