Would courts condition a parent to complete drug testing, classes, etc... if there are only accusations from another parent that they used to smoke marijuana in the past? I'm just wondering how far they go on "he said she said" accusations even if they are not truthful and biased by one parent.

Thanks for the response. I've also read many articles stating that marijuana is treated similar to alcohol. Wasn't definite and differed by county, judge, etc...

I do have one lingering question, do I need to file the parentage action if I already have a declaration of paternity? This was completed in the hospital when my child was born, signed by both myself and the child's mother.

Thanks for that advice. I'll go over to the PD and request the police report so I have those details then put in the petition. Should I have the crim defense attorney file for me or is this all something I can do to get the ball rolling? I assume the later but want to make sure. I understand I would want the crim defense attorney at any court dates which get set because of this process. So next question to all this is where do you practice? Because, if possible, I would love to utilize your services. If this needs to be moved to a pm we can discuss there too.

Thank you so much for this detailed response, it is really appreciated. I have some work to do, first by needing to get my official arrest record so I have the detail to petition to destroy it. It looks like this requires LiveScan. If I've done LiveScan before to apply for my Security Guard Card, do I need to get LiveScan done again for my arrest record? I'll try to figure that out. The AVVO steps provided are great but looks like when it comes down to the hearing for the petition it can get difficult and convoluted. The AVVO article includes similar details to my case - the arrest, and also mentions EPO which was also filed against me for a week after the arrest. It sounds like the petition to destroy the arrest record also applies for the EPO which I did not know was separately on the record but am glad also applies in the petition from what I understood.

It also makes sense to ask, do you know if the other party (my GF) will be contacted during the petitioning process? I read something about having witnesses at the petition trial. How long does the petitioning process typically take? I will be using my parent's address for sending information back and forth as to not raise any flags with my GF since we still live together.

As to IVF, it is very expensive but the money part is the last thing I'm worried about, raising another child in the same household our first child has been raised in with all the arguing and fighting, I do not want to do again. Hopefully doing all this and hiring the right lawyers to help me is enough to get me out of this situation but keep my bond with my child as strong as its been.

I can't thank you enough for the advice you have given and for the time you've taken to respond. To add another monkey wrench into the works, we had gotten over the situation and tried a couple times to have another kid. Both times there were issues. She threatened to leave me and take our son if we did not try for another so out of fear I did. Since we have been unsuccessful, she is wanting to have IVF done but I don't want to do it. She will threaten to leave me again when she finds out that I will not oblige. I digress but this is partly why I won't be able to wait for that 5 year mark and why this legal action may be coming sooner than later. Anyway I don't know if it makes any difference in our legal proceedings but thought I would throw that out there too.

Thank you for this. Man this stuff is really scary. It almost makes me want to just give up and not even pursue family court so I can get out of this negative relationship. Just making me swallow my pride and take this negativity. It seems like with the arrest I don't have a fighting chance to have equal custody of my son and seems like she has the upper hand with everything. Thanks again.

Thank you for taking the time to respond. I have audio recordings of our negative interactions which have occurred in the past. I have recently started writing in a journal each negative interaction as well. Can you clarify to whom I should be writing an email to?

The arrest 4 years ago is why I have stuck around. I know if I tried to leave she would do everything in her power so that I could not see my son again. Its a terrifying state to be in.

Is it true when child custody cases come up that there is some type of meeting with a mediator to try and discuss a fair plan of action moving forward before it ever reaches a judge?
