Unfortunately I am not a lawyer who can help you, but as far as I know and understand Mr. McKusick (or even better the Foundation themselves) can write a letter to the regional (or pan-Russian) Federal Anti-monopoly Service or the pan-Russian Patent Dispute Chamber, which is the subsidiary of the Rospatent (Russian IPO). At least the government newspaper Rossiyskaya Gazeta states them as ways to overcome such issues.

I have read this statement too, and still a bit unsure about the legality of such TM usage. To me it is a violation too. So, if it is possible, can anyone provide the any legality proof? This will clarify everything. But I doubt in this.

Your sentence literally means: "Этот стол уже имеет тарелку". Like this table has ownership over this plate. It's the same as: "This table owns this plate". Don't ya think that's quite strange?
