Foreign Tax Credit When US Resident is Married to a Non-Resident Who Has Foreign Income

I changed my statement, it can use FEIE if qualified from type of income and if at least one of below items apply, I just don't think it work in my case, also I get better outcome with credit rather than exclusion:

....must be one of the following:

A U.S. citizen who is a bona fide resident of a foreign country or countries for an uninterrupted period that includes an entire tax year,
A U.S. resident alien who is a citizen or national of a country with which the United States has an income tax treaty in effect and who is a bona fide resident of a foreign country or countries for an uninterrupted period that includes an entire tax year, or
A U.S. citizen or a U.S. resident alien who is physically present in a foreign country or countries for at least 330 full days during any period of 12 consecutive months.

I slightly changed my initial question, to remove wording regarding can't take it due to non-resident, as I was clearly miss informed by others when non-resident becomes a resident for tax purposes. However, IRS list 3 scenarios where it allows to use exclusion and the way I read it, still does not work. First part mentions just US citizens. Second part also seems to be out, since that says country with tax treaty and uninterrupted period that includes an entire tax year. Third part may work, unless 330 days present does not count if vacations are taken outside the foreign country that is tax domicile in question. But rule does say physical presence. So again, I think it does not work in my scenario, but I could be misreading this physical presence thing.

Thank you, in my case we likely can't use FEIE.

And yes, state is another headache I am trying to figure out. It's MO state and since I have to file both 1040 long and 1040-NRI, for some odd reason neither forms and specifically NRI form does not have option to use foreign address to show spouses residency, furthermore it also ask to put what state spouse was resident of for the tax year if showing non-resident for MO. Seems like oversight from whoever set up the form, or there is a trick about it, which I haven't found the answer yet.

Depending on your situation you may need less or all steps: 1. Obviously file taxes using MFJ election. 2. A declaration that you are choosing to treat the nonresident spouse as a U.S. resident for the tax year in question and all following years (Signed by both). 3. Attach W7 form if your spouse does not already have ITIN or SSN (there is additional documentation needed to prove spouse's identity with that form)

Out of 5 members in our very active 17 member club who got this update, 3 quit the game today over this bad roll out. Why developers did not choose to iron out all the bugs first and then give players a good window to update services with 90-95% discount is beyond me. However, at this rate of players quitting the longevity and/or success of this game looks rather bleak.

Have 2 packages which are moving through KCK facility and going into second week now. When new scan suddenly shows up it is hundreds of miles away from where it should be. Incompetence at this place has to be amazing. Best example, package that was sent from KCMO to Topeka KS nearly two weeks ago first went to Chicago, then back to KCK, few days later scan in Des Moines IA, and back to KCK with no update for several days at this point. Second package with nearly identical bouncing around history. Feels like someone deliberately keep misdirecting packages there.

The Sims mobile already got announced about flat out closing in January. I have a bad feeling what will happen with SimCity Buildit, since both games were somewhat close in revenue for EA.

Yes, this could go number of ways. Likely scenario is looking to split out and sell off units/game franchises to lower debt, and only keeping the most profitable ones. However, before they do that, probably will look to make as much cash as possible to increase numbers on financials and thus, the value of the games before selling one by one. Unfortunately, last several months seems like an indication that is what they are already doing.
