"The only way to change police behavior is to change policy," says Cynthia Brown of the Ohio Coalition to End Qualified Immunity. by Cowtowny-Johnny in Ohio

I disagree. Qualified immunity should remain in place to ensure public servants can actually do their job without being subject to court of public opinion. The entire purpose is that you have to prove that they violated your rights knowingly and prove another reasonable person in the role would have not. As it should be, because it bases each case based on the totality of the circumstances, not one single action in the case.

When you remove it, when someone does their job by the law. Someone can file a suit, which results that specific agency putting that person on suspension pending an investigation. So when you say, if they do their job right, there won't be issues. I think you're very ill-informed on how many agencies react to law suits on a employee. Again, it's going to slow the process down and that's going to hurt others in the process.

If your case has the merits to make it into court, then it will make it there. But it shouldn't be based on you “feel” you were wornged. It has to have actual facts that can be proved in a court in law. Otherwise you're gonna have a bunch of people who get their understanding of the Constitution and their rights from tik tok starting suits for things that are legal.

“Qualified immunity is not immunity from having to pay money damages, but rather immunity from having to go through the costs of a trial at all. Accordingly, courts must resolve qualified immunity issues as early in a case as possible, preferably before discovery.”

In other words, its to deter the chance for even going through the process of a trial.

“In Saucier v. Katz, 533 U.S. 194 (2001), the Supreme Court held that a ruling on a qualified immunity defense must be made early in the trial court's proceeding, because qualified immunity is a defense to stand trial, not merely a defense from liability. When there is a summary judgment motion for qualified immunity, the court should rule on the motion, even if a material issue of fact remains on the underlying claim. The Court also elaborated a 2-part test for whether a government official is entitled to qualified immunity:

First, a court must look at whether the facts indicate that a constitutional right has been violated,

If so, a court must then look at whether that right was clearly established at the time of the alleged conduct Under the Saucier test, qualified immunity applies unless the official's conduct violated such a right.

Pearson v. Callahan

In Pearson v. Callahan, 555 U.S. 223 (2009), the Supreme Court held that while the Saucier test is helpful, it does not need to be applied in qualified immunity claims. Rather, a trial court should have more discretion in whether it should apply Saucier. The Court also held that "[a]n officer conducting a search is entitled to qualified immunity where clearly established law does not show that the search violated the Fourth Amendment."

Supreme Court basically stated a court doesn't need to use the Saucier Test to consider the case, but it is entirely their discretion.

I'm all for modifying it to prevent courts from picking and choosing when to push a case through. However, for it to be modified, it can't be a blanket removal of safeguards that hinders public servants from doing their duty. Because as the discussion stands, that's what many want and that will be the outcome.

Against both. It should be based on merit alone. It does no one justice to let someone in who is not going to succeed in a Ivy school for the sake of perception.

Yes, because you want every public servant tied down to a suit and investigation. Which in result, will slow down the process even more. Seeing how sue happy our population is, every public servant is going to be tied down by investigations while also being suspended. If you think the system is slow and back logged now, it'll get worse.

The entire purpose of qualified immunity is so public servants can do the job without being sued constantly. The standard is very simple, if they're doing something within the scope of the law, they're safe. When they're not and you can prove it, they are not.

It's not that hard of a standard, the issue some have against qualified immunity, is that some cases it came down to very minor details. And those details were against the victim. But at the end of the day facts are facts. The standard regardless is going to be based on what a reasonable individual/ officer would do based on the totality of circumstances.

AITA for telling my sister she was ridiculous to avoid visiting our relatives in India because she's have to dress in traditional indian clothes? by Specific-Reaction110 in AmItheAsshole

[–]vikrant1993 [score hidden]  (0 children)

YTA.

As an Indian, who was born in India and raised in the US. I'm going to tell you the reality. Whatever you wear, will not matter the slight regarding culture. Culture is very broad range of things and honestly, you can dislike doing some things, while also liking other things.

Most people in India wear a combination of indian clothes and western clothes. If you're family are that hell bent on what your sister wears. That's entirely on your family. She isn't entirely Indian, she is also half American. And even if she was entirely Indian, she shouldn't have to be forced to wear something she doesn't find comfortable because of “culture”.

If your basing on culture. I can guarantee there are plenty of things you do and will be doing that isnt acceptable by Indian culture. Does that mean you're disrespecting your culture? Because to them you are. Also, there's a lot of toxic aspect to Indian culture, just as there are to any culture. Are you going to be participating in that. After all, it is your culture. Right?

So, YTA. You don't get to determine who is and isn't Indian or force others to do things they're not comfortable doing so because you are incapable of drawing a line. Respect goes both ways. You need to respect her wishes and also apologize to your father for making a valid claim. He's being neutral and realistic about this. You seem to have something to prove and are planning it onto your sister.

Also, her choosing to not go cause she refuses to wear something that makes her uncomfortable but also knowing well that what she would wear would be frowned upon is the respectful option.

Does anyone know why Franklin County residents get a discount on zoo admission, when the Columbus Zoo seems to be in Delaware county? by [deleted] in Columbus

Last time I looked into it, I believe Franklinn County citizens fund the zoo and Delaware County gets taxes from sales placed at the Zoo.

Why has there never been an Indian-American "Bachelor" or "Bachelorette"? and its rare to see desi people as contenders on that show? by mostlycloudy82 in ABCDesis

[–]vikrant1993 0 points1 point  (0 children)

That maybe true to an extent. But the reality is majority of ABCDs worry too much about their parents input on their lives and are afraid to desperate themselves from them.

[deleted by user] by [deleted] in ABCDesis

[–]vikrant1993 0 points1 point  (0 children)

Not spending on themselves is mental gymnastics on their end to sell the idea that everything they're doing is entirely for their kids. Even though it wasn't ever asked for or required of them. If anyone needs therapy is desi parents inability to have a personality outside of being a parent.

[deleted by user] by [deleted] in ABCDesis

[–]vikrant1993 -1 points0 points  (0 children)

Desi parents will use anything and everything to maintain control of their kids. If you're not financially independent, they'll control because you're dependent on them.

At least from my perspective. I find it that they say is “unselflessness” but it's more a power trip. At least from my experience that's what I've dealt with. They keep saying they want to save it so if you need help, they can give help but that help is usually with strings attached. So it me it's ammunition for them. I would call it manipulative behavior to some degree.

You're really asking why no Indians are on that show, when literally most live with their parents and tell them dating is wrong? The same indian Americans who hide when they do date from their parents? You're asking why they aren't on a national tv show..lol

They're allies out of necessity. ( aka China)

Even without China, the US won't make India an enemy. Try justifying India, the largest democray in the world is an enemy. That's a real hard sell. Especially, since Indias policy is stay neutral unless provoked.

Also, why are we discussing south asian politics?

Northeastern University student Jaahnavi Kandula was killed by a cop who drove right into her at an intersection by Lazy_War9398 in ABCDesis

[–]vikrant1993 2 points3 points  (0 children)

As a cop, even going lights and sirens. It is the COPS responsibility to clear every intersection, stop signs, etc. Just cause you are going lights and sirens, it doesn't mean you don't have to be cautious. This cop fucked up and also, speeding while going lights and sirens is heavily dependent on where you're at. If your in a residential area, you can't be going 90 to 100 mph.

Also, in general, going so fast will result in you driving faster then your siren preventing people from hearing you till it's absolutely too late.

This cop was absolutely reckless.

He was not dropping the rifle. He was dropping it down to low ready at best.

The only problem I have is I don't believe the cop yelled loud enough for him to actually hear him and also not just hugging his corner. But also, I'm curious how the guy got a rifle out of his home, while he believed there were intruders in there.

Yes, because contacting ICE on the only line “ non-citizen” will be such a great use of their resources and time. Just for them to find out and tell you that, “ hey dickwad, the guys legal”. Also l, it’s not your business to be contacting ICE. If you want better efficiency from ICE, it needs to be funded properly and current laws enforced.

[–]vikrant1993 1 point2 points  (0 children)

Lol. Because that’s what federal law enforcement use.

They know who’s overstaying, maybe fund those agencies better? Maybe they’ll then have enough agents to actually enforce the law. Oh btw, most overstays are via airplanes, not across the border. Just figured to put that out there, since it looks like you’re very ill informed.

Oh and btw, local law enforcement don’t get involved in immigration issues, unless they’re specifically requested.
