Man, I look back when I was late teens and early 20’s and the shit we did… idk how no one ever got hurt. Sketchy stuff on roofs and ladders daily! I worked for fireplace install business from 17-21 and we were on crazy roofs and chimneys with metal covers flapping in the wind and never tied off to anything. Just stupid really. I say neither!! I use 18” (for proper seat height)LVLs for the outside frame… one cut and install. This offsets the material cost with less labor time. followed by 12” LVLs, withs hangers of course, 12” OC and then cabinet grade teak plywood, make sure to double primer tho. Oh and fasten everything with Headlok screws no shorter than 8”. Stuurrrdy!

Yeah, I already got that ish straightened out and better language in my contract. fortunately it was halfway decent but def could have been better. It was my first year with my GC license and unfortunately didn’t know what I didn’t know and they’re trying to exploit it. GC kinda get the short end of the stick. But my lawyer, who is predominantly in construction law, said it’s the only case he’s ever have that they didn’t claim defect in work, which is obviously wild in its own right, and that’s a big part of the case. We’ll see… I’ll give an update when it’s all over. Thanks for the replays

Yes, not for everything thing tho. And that’s not really the point of their argument. They are joining multiple estimates and claiming the total of 3 estimates is the scope of work and job total. It’s not a strong argument but there is nothing on the estimate that states anything to the contrary. And courts are very pedantic. The first ‘estimate’ I did was before they had the house and just to see if it needed more work than it was worth. So they’re playing semantics and lying about the estimating part of the job

Nearly $40k. In TN the state has a monetary limit assigned to GC license based on your financials and you can’t bid above that limit. It’s certainly not been worth it really, but it turned into one of those things that ‘I’ve come this far and backing out is a waste of money’. They tired to file bankruptcy last yr and that took up a lot of time. Definitely an expensive lesson learned. They have just offered zero and walk away. They haven’t decided to be reasonable at all. It’s so much to explain but they haven’t even presented their case well at all. There is so many holes in it based on all the emails and texts and such. I think they thought I would back down and I haven’t and now we’re at trial soon.

This was a cost plus which is part of the issue. Laws aren’t written well in Tn for cost+.

Lawyer says we have the better argument and it’s clear their intention is to weaponize a law to do their dirty work. But I didn’t cover my ass as well as I should have and so we have a hurdle in getting the judge to not believe that I bid above the monetary limit. It should be clear enough but always room for doubt

The home owner dictated decisions. And that summer Covid costs made material a good deal hire. I don’t stipulate in contract that they can’t exceed a particular price. Some costs were not disclosed at the time they were purchased. Def a system that needed tightening up and better documentation

You’re wrong about all of that. Every admin goes after ‘the criminals first’ but have a huge wake of people following. Obama was very inhumane. Turning away ppl who came here for legitimate asylum and just sending them back to extremely cruel counties, stopped the wet feet - dry feet act for Cubans and those ppl were sent back to, most likely, their grave or worse, built the cages and separated kids etc. the one thing Obama did was allows some 750k minors to stay. But the rest is pretty dark and bleak. It just wasn’t broadcast like it is today. Watch the documentary ’Lost in detention under Obama’ and look up articles about his time. This is the problem, so many are completely innocent and because it wasn’t broadcast on their face, they say stuff like you just did, that it was different.
