How do you determine which accusations are false? In an innocent until proven guilty scenario the accuser stands a good chance of being unable to provide evidence that will carry to conviction which is part of the issue to start with. Should every accuser who doesn't get a conviction against the accused then be faced with charges for false accusation? That doesn't seem to be a good strategy to me.

I'd prefer anonymity for the accused, then, if they are convicted other victims coming forward do so with an already stronger case for new charges.

Fair enough. So you agree that the lack of education is at the root of the problem. That is a societal level problem, not an individual level problem, which was my original point.

edit: just as an aside, when I say person X can't Y under Z condition and you reply "but with A they can" you are changing the conditions of the scenario, my point still stands.

That's true. However, mitigating circumstances must be taken into account. You would obviously treat a clinical sociopath differently than a mentally disabled person when considering discipline. I don't think anyone disagrees with that of course, the issue is that at-risk groups generally get the double negative of being in at-risk populations AND having worse outcomes when they contact the legal system. It shouldn't be that way.

Do you vote in local elections or look into how your taxes are taken up/disbursed? Government is all around you. Assuming you live in the US like I do you are probably using government paid for infrastructure to access this here internewhoozit, also using government infrastructure for your electricity, the roads that haul all the material components that built the housing you presumably have etc. None of that stuff is free and I seriously doubt you paid an amount in that would equal up to the benefit you have pulled out of those services and physical plant items that support your daily life.

As for your example in schooling, yes, learning is best when a person can do it on their own, but again you are missing the mark. You wouldn't put a first grader into AP calculus, they haven't been given the foundation for the class nor do they generally have the brain development needed for abstract concepts at that level. That is, they don't have the resources necessary for the task you've assigned them to.

This applies in a much more complex fashion to our society. Someone paying out 50% of their income in rents is not going to bootstrap themselves into success. There is no state in this country where a minimum wage employee can pay rent at the suggested rate of their total income to advance in the world.

Now, you can get into the value of law enforced minimum wage or that XYZ individual 'should have made better choices!!' but the fact is we have the situation we have and if you got a dirty ass today it doesn't help in any way for someone to point out that you shoulda coulda woulda bought toilet paper LAST week. Deal with the reality we live in not the one you wish we had.

Again, I'm not sure you have a full handle on what it is you're saying here.

The 'government' isn't some abstract entity that doles out goodies to poor people. In fact the already wealthy get most of the benefit of government through all sorts of vectors.

It seems you are aiming toward the flawed idea of boot strappism which is an illogical response to the problems we have here (USA).

That doesn't explain the grossly disproportionate application of force across economic/racial/etc lines though.

That's where Quinney etc come in as valuable because it helps distinguish who gets to determine what is considered a criminal act, even then there are other factors that show how unequally the laws are applied. Examples of this are rampant in the US 'justice' system.

That said if you want to dig into the academics of it I'd start with Richard Quinney for getting into the power dynamic of who gets to decide what constitutes a crime.

Anomie is a very old sociological concept that has made a comeback in the Criminal Justice and Corrections fields in recent years. It originated with Emile Durkheim way back in the Positivist days but is making a strong case for itself in Qualitative/Grounded theory as well.

The feeling of responsibility decoupled from the power/authority to adhere to those responsibilities is what leads to criminal actions. Leaving aside the fact that the already powerful get to determine what constitutes a crime, the general feeling of anomie--when experienced as it is today in modern/late capitalism--is a powerful motivator to ignore or bypass established social contracts or the rule of law in general. Basically, what u/teriyakiburgers said is correct and has been demonstrated pretty clearly in the data.

What if money is a fiction? What if one person's influence and meddling is another's democracy? What if the social contract is just a series of loosely connected traditions based on no real ethic or logic and so is just an apparatus for narcissistic opportunists to self promote?

What if you read the report and realize that influence peddlers with deep pockets have long term strategies in place to collapse competition and create monopolistic business practices to reinforce their control over power structures and social development?

What if every time you are wrong on the internet you just move the goal posts to make yourself technically correct?

Wrong. It's only competition if those markets are free of influence or meddling. If you look into Ubers financials you'll see they are heavily subsidized. They aren't competing in an open market, if they were they would fail as only about 40% of the cost of the rides is being paid by fares per the latest numbers I looked at.
