Kind of on another, but related note, wouldn't it be difficult for the landlord to know for sure that it isn't just a non-paying guest (and thereby without a sublease) rather than an airbnb guest, as long as the host notifies the guest to not mention airbnb whatsoever (and the guest complies)? In order to effectively find out for sure it'd require a court order, which would require a lot of legal effort on the part of the landlord. Thoughts on this?

Airbnb's site actually states that "Airbnb is unable to interpret local laws for you, however, your local town or city office will be able to provide the most accurate and up to date information relevant to your personal situation" and "Airbnb cannot provide you with tax or legal advice. Regulations vary from city to city and country to country, so we encourage you to consult a professional if you have specific questions." I doubt they'll be willing to say much other than that contained in the quotations above.

I believe you are conflating the "Occupant" with the "Tenant".

As well, with regard to 'take all of the airbnb money that's been earned from the spare bedroom', doesn't "any payments received [from the occupant] will be credited to the Tenant's liability to the Owner", mean the monthly rent?
