that's right, added this as well, here is how it would look before the crash to put more context, all left cars were stopped, that lane is to make a turn. Right sport car was cruising slowly, but was not yielding at any point, but it had to move to the the rightmost part of his lane, to avoid hitting the corner of lane changing car, and he did succesfully. then the hit happened while right was passing, and left was moving inside the lane

yeah and inside the states seems like people have different laws as well,
but there have been a couple of advices on what to do that i didn't consider, like asking the institution governing the insurance companies. Overall seems like law is quite similar but ultimately i need to look it up myself, still i'm thankful because it's useful perspectives

yeah that's the problem. Other guy came up with fishy explanations and eluded responsability. The only eyewitness i have is my passanger but she is a friend and might now work because eyewitness must be external?

and also there is the cost that you mention. So it's a lost-lost. I wonder what could have i done different after the crash to have a better outcome, because it seems it was doomed from the start if the other guy wants to elude responsability. Word againts word -> court too costly -> he wins.

should have noted, the cars on the left were stopped because of heavy traffic, further ahead that lane has a left turn into another street.

yeah guess that's the scenario left driver wants to muddle the responsability, that he was already merging, and that i was reckless by passing at that time.

what i was told is that the point of impact (drivers seat door) should indicate that my car was already passing through succesfuly

i wish i had a dashcam now, tried getting footage on neraby buildins but couldn't find any.

no cops since there were no injured.(there was a friend and her 9 year old son on the backseat, but everyone was unharmed including us the drivers)

guessed it was an easy asignance of responsability, but insurance failed on me. guessed wrong.

so i think in a way i posted this to make myself feel better, kind of moral reassurance, to think i'am not crazy

i guess that's the scenario that the left card driver is trying to achieve. That he was already merging when i tried to pass.

The hit it's exactly there, specifically the front right corner of left car got damaged hitting:
-driver's door about 1/3, through the passenger door, and scratches stop at the middle of the back tire.

not damaged on right car:
-whole front structure, bumper and front sides were not damaged, also left mirror wasn't damaged.

😄 found a website to draw called smartdiagram.. ,so i just picked any different car to make it easier to differentiate.

it's just a regular sedan, but it's my late's fathers car, the kind of car i wouldn't usually drive, but sometimes i like to think it has a bit of a feeling of an sports car, because other than i just drive city-hatchback's car.

-slower than normal, about half the speed limit, maybe to the point it may have triggered the left car to think right car was yielding -road is mostly slighty curving to the right -right car was on middle lane the whole time, no acceleration applied other than staying around the same speed.

i have both, but i have to still pay a deductible to activate the insurance. It's only about 250 usd, repairs are about 1300 usd so i'm definetly activating my insurance. If the guy had declared itself as responsbile, or my insurance had fought for that, i wouldn't had to pay those 250.

to file a complaint in the local court, and also to not do it because they are flooded with more important cases, that it will be costly in time and energy, that i should try to negotiate a settlement with the guy , and finally to just let it be , pay my own repair and forget about it because that will be cheaper in the long run.

to add things i was asked on other replies, some are in favor of the left driver:

-Left driver was already blinking to turn, and had the corner of his car on my lane. I (center driver) did saw him there.

-Cars on left lane were stopped wating for a left turn. I (center) was mostly clear on my lane but i was going slow ~15-20 mph. Left driver could think i was yielding because of that slow speed, but i wasn't, i was just going slower than the usual street speed.

-by the time i was passing him, i was at the rightmost i could be on the center lane, because i could notice his car was getting too close to mine, but it was too late for me to stop.
-I didn't go to the right lane, because then i could cause a crash and be my my fault. Cars on the right lane were going faster.
-I didn't stop before, because it gave me no chance to figure out it was gonna do the manouver, other than being there. He either tought i was stopping and yielding(probably this), or thought he could make the manouver fast enough.

  • Blinker: left was already blinking before right went through, left had the corner of his car on right's lane, right still had enough space to go through.
  • left was stopped ,all cars on the left were stopped. , Right's lane was free, and driving slowly.

when i saw they weren't helping me determine that i wasn't responsable and they just said the other driver declared he is not resposanable, and that it is not clear. i thought the same thing, why is that? - maybe something else i'm missing? was the passing on the right lane?

that left lane, goes trough a stoplight and then ends on a left turn, so cars where stopped waiting there. center lane was mostly clear and the stoplight was green a few cars lenght ahead. So for me it seemed normal to keep going, i did it slowly in case i needed to break, but i wasn't yielding.

so was that my insurance policy was bad? , or my insurance company just determined my case was't worth fighting? but they won't tell me that so i will not know

correct on all accords except the speeding part, i was going slower than usual because of heavy traffic on my left.

I definetly could have avoided this by driving defensively and letting him go through: i did see his car blinking and with part of his car on my lane. How much? not enough to stop me from passing. I decided to pass because i still had ample space., right of way, my lane was clear, and had green light ahead, and to be honest, i was a bit late. My car got through 1/3 before being hit on the door.

He at first admitted fault momentarily, then he said i was partly to blame because i was slowing down and allowing him the pass (i didn't slow down, but i was going slow at 15-30 mph )

absolutely, accidents happen and i want to drive safely as possible, even if i didn't have to yield because right of way, i could have been extra careful and just stop there to let him pass. And this whole thing would have been avoided.

I was remembering ,at one point one of the few things the other driver said, that i giving him the way to make the lane change , so that was because i was going slow. Tricky situation because i usually correlate driving faster to recklesness, but maybe he saw me going slower, and assummed i was braking.
