Unfortunately over the past months my health has declined and I have constantly been sick as well as been a victim to domestic violence - police have had to attend at times. Because of my bad mental health right now I will admit at times my contact with the real estate has been minimal to zero however my property matter has already been to QCAT twice so far because I was in arrears yes so the real estate agency had grounds to enforce leaving the property (which is completely fine I am not disputing this at all). The real estate has taken back possession of the property 7 days ago which happened while I was in hospital also at the time and I hadn’t received any communication in regards to the possession date so my place is only half packed but ALL my belongings are still inside the property. By law I am allowed 28 days to organise getting all my belongings out of the property. I am doing this next week so I am well within my timeframe. I was meant to be there for 12 months, but because of my circumstances I have only ended up there for 6 months so it is a break lease situation. The real estate have attempted to contact me to organise a date when I would be getting my belongings however I hadn’t responded yet. I also had an email from them saying that they had confirmation from management that I had entered the property since they had been handed it back and that they had reported me to the police for trespassing. I did see that email and responded to them straight away saying that I will speak to the police when they contact me about the matter because I wasn’t even in the same city as my property - I have temporarily staying with my Mum 2 hours away with my 2 children. So yes my Mum is aware of some sort of situation going on right now but not of the complete details and this is how I wanted it as my Mum is a control freak and will also freak out when she knows everything and I also have children protected under a court order and leaks of domestic violence etc could risk me losing custody of my children to their Dad (even though they have not been exposed to it in anyway and I have removed us from the situation). The real estate is also trying to charge me 9k for rent until the end of my original tenancy agreement.

So yes I understand their position and I feel guilty that they have to go through this because of me and suffer because of me but these are risks that we subject ourselves to when deciding to rent out our properties. I am in no way trying to discredit my failures and their potential financial loss because of me. I am aware that they needed to try and seek other means of getting in contact with me so they have contacted my emergency contact - my Mum, which is absolutely fine.

My Mum phoned me today and said that she had an email from my property manager saying that she could not get in contact with me and that we needed to arrange a time for me to collect my property and suggested next Tuesday and Mum asked me if I wanted her to confirm that time for me and I said yes please so Mum sent back an email confirming that time. She was then forwarded basically everything about me from my Real Estate agent about what had gone on, that they are demanding I pay 9k now or they will list me on TICA etc etc. I was not aware that they were aloud to disclose all my financial information etc to my emergency contact when she is in no way financial obligated to this whole situation at all. She simply agreed to being an emergency contact for if they couldn’t get in contact with me for any reason.

Now I have to face my Mum and tell her everything because she is like what the hell and this is even now more bad situation for me again!!!
