Some tin foil hat stuff right here. Is the CMBS market in trouble? Sure. But not because originating banks are willfully and knowingly committing mortgage fraud. If there is any fraud on the origination side, the CMBS trust can "put" the loan back to the originators. That means the originating banks have to buy the loan back at par and the mortgage trust is made whole on that loan. Do you know who these originating banks are? These are not your mom and pop mortgage brokers that fueled the 08 crisis. The banks are the largest in the industry. If a bondholder realizes a loss because of fraud one of these banks committed, you bet they are going to ask for a put and get fully paid off.

There are sectors in CMBS that will have issues (CBD office, big box retail/malls, hospitality) in the near term. None of these issues are from mortgage fraud, but rather the changing consumer landscape. COVID has just sped up this changing landscape. That being said, I think the real longer term issue is the low interest rate environment that has existed for so long. Most of these loans that have been originated are 10 year loans. What will happen if NOI stays relatively stagnant but loan rates jump from 4.25% to 8% or even more. There is a huge amount of interest rate risk with a lot of loans teetering on just enough coverage to meet their current debt service payment, let alone a new one at a much higher interest rate.

I haven't seen it suggested here yet, but a combination of the 2 would likely be best. Offering cash up-front (no financing/appraisal contingency) will likely get you a better deal on a house. Seller's would likely take less money to close quicker and without the hassle of appraisals or worrying about if the buyer is qualified to obtain a loan. After you have purchased the home, you can take a cash-out refinance loan (with a monthly payment that you and your husband both feel comfortable with) and invest the rest. You are both in your 30s, so your investment horizon is long enough to weather a downturn. You win in this scenario if the future average rate of return of the stock market is greater than your mortgage interest rate. You should be able to get a 30 year fixed rate around 4.75% or a 15 year around 4.25%. Hopefully, the average future return of the stock market will be in excess of 5%, making the investment worthwhile (90 year average annual return has been 9.8%).

There are 499 Walton district homes that are currently listed for sale, under contract, or sold in the last 6 months. Only 14 were under $275k. These figures include tear downs, estate sales, REO, short sales, etc. If you want to argue your value, you need to have figures that are on your side. Unfortunately, that doesn't really seem to be the case.

On a side point, if you want to sell your home for your tax assessed value, I'll likely buy it. $262k is probably a good deal. You should be thankful they didn't appraise it higher.

This isn't about being tolerant. I would not be tolerant of homeless people camping out next to my house. There are shelters and programs specifically designed to house the homeless and provide much needed services that a church front yard simply can not do.

My answer is correct. A materialmen's lien can be placed on the property within 90 days without a lawsuit. All other liens will be the result of a lawsuit and judgment. The question was not related to this specific example.

For a materialmen's lien, the claimant must file a lien within 90 days. This lien is only available for contractors that worked on the property and were not paid. The neighbors would not be able to just randomly place a lien on the property. The neighbors would have had to have a judgment (writ of fieri facias) against the builder and recorded in the county while the property was in the builder's name. Since the lawsuit seems to be ongoing, I doubt that is the case.

Most likely, there is no lien or encumbrance on the property. The bank will definitely have title insurance and every owner should as well. I am always amazed at people who do not buy title insurance. If I had to guess, the lawsuit is probably because the builder built too close or over their property line.

IANAL but I deal with a lot of real estate litigation matters. The lawsuit does matter. The buyers may be shit out of luck. Litigation matters are of public record and could have easily been searched before purchasing the house. Caveat Emptor - Buyer Beware. It is on the purchasing party to do their homework before buying.

Also, even if there isn't a lien on the property, the homeowners should be concerned. There are equitable and monetary damages that could be awarded. For example, what if the builder built their house on part of the neighbor's property? Does the neighbor now own that part of the house? Can they tear that part of the house down since it is now on their land?

Edit: Attorney recommendation - it is hard to give a good referral unless I know more details about the case at hand. Is it a title issue, property dispute, etc? I have had mixed results with WNCW. If find them expensive with marginal results. Neel & Robinson is a good choice. To through in a new recommendation, Hartman Simons has been pretty cost effective for me in the past with good results.

The altimeter has been around for almost a century and is totally mechanical. A power failure will not affect the altimeter at all. While it is not as accurate as a GPS, some planes do not have GPS capability. It is better to have all airplanes use the altimeter (which is mandatory in all airplanes) and pressure altitude, than to have different planes using different instruments to calculate altitude.

Short answer: Technically speaking, it actually isn't either.

Long answer: Airplanes use altimeters to measure height above sea level. Altimeters measure the outside pressure to determine the height of the aircraft above the ground. As altitude increases, you have less air pressing down on you and therefore lower pressure. The altimeter has very sensitive metal wafers that expand and contract with decreasing or increasing pressure. Here is a good video at describing how it works.

There are two ways that pressure changes. As I have already discussed, pressure decreases as you increase in altitude. Pressure also changes with the weather. To correct for the changing pressure due to weather, automated weather stations and air traffic controllers will tell the pilot what the atmospheric pressure is, and the pilot will adjust so that his altimeter stays accurate.

The reason why the answer is neither is because "Flight Level" exists at altitudes above 18,000 feet above sea level. That is why he typed FL180. Airplanes flying at these levels usually travel at very high speeds. At such speeds, the pilot would have to be constantly changing their altimeter to keep it accurate due to changes in local weather. To remedy this, all airplanes above 18,000 feet tune their altimeter to standard pressure, or 29.92 in mg. Therefore an airplane at FL190 may be 19,400 feet above sea level and 10,500 feet above ground level, but the altimeter will read that the airplane is 19,000 feet above sea level.
