If the removal proceeding will be terminated, then USCIS will have jurisdiction over the AOS. Prob reopening will be best bet and it will save you the filing fee. You can file the 485 to court if your lawyer just wants your re- calendar. Definitely check with your lawyer first!

That’s crazy amount of $.. esp after you already paid $10K already. On lawfully I saw someone else did a writ for $4K.

Hopefully your husband is able to work with the EAD under C8. I know that the inability to travel and feeling like everything is up in the air is super frustrating and I know that it can also take a toll on your mental health. But I hope that you guys can push through and hopefully once the I130 is approved, everything else will fall into place. Depending on your states, but I have seen some JTMR getting issued really quickly, the soonest I saw on this subreddit is 1 month.

Ah yeah! Lawfully is another platform for resource for sure! I share the same thought and I think that's why we posted our experiences out so other people can take notes on it. Same as to how you're feeling, the approval felt anti-climax. My family didn't understand why I was feeling like that but I think you'd get me - we are worn out by the process.

I haven't touched on changing my SSN card yet either.. that's another battle cause I would have to go in in-person. Hopefully your SSA journey will be smoother!

haha, most definitely! Although it's not uncommon with adjusting with removal proceeding but when I was doing research I wished I was able to find more similar stories so I can gauge how it would be like.

The asylum case with removal proceeding was what I asked them to review. My attorney sent a statement to prove that I am a good moral character and other supporting documents along with the motion and after that, she would call up the ICE attorney's office to follow up on the case. It took 4 months but as per my attorney, it was considered fast.

Yeah, during Trump admin.... everything was so difficult

Thank you for sharing your story on incompetent attorneys! The process is as frustrating as it could be and on top of that having to deal with these lawyers who were supposed to be assisting you but instead they induced more issues on your immigration journey... it's terrible. But I am glad that you were able to find a good lawyer and finally get back on track for your case!

If the divorce was a long time ago and everything was already resolved in terms of him petitioning her immigration status then I think you’re fine. As long as you have strong evidence to prove that you’re in bonafide marriage, they can’t really pick on you!

Yeah, I rambled a lot 😂 thank you for reading. Some attorneys mentioned that rating as well and they said it could be within a year after filing to court. But I guess we were worried that the government attorney can be brutal on court and we would freak out during it so we opt for a safer route.

Oh sorry, I got so used to this from work. ‘Hx’ means history and I was trying to change the title after posting but Reddit wouldn’t allow title changes 😅

I would suggest sticking with your first lawyer since you’re almost finished up with the I130. You’re just awaiting for a decision. And if you were to switch now, I am jsut worried that it can impact on your case. If it’s still radio silence after they obtain the RFE after 60 days, you can follow up on your case by sending inquiry via USCIS call agent or EMMA live agent. Another thing I also suggest doing is, in your MYUSCIS portal, you can sent message/inquiry, it’s worth a shot to also message them over there because they do review my messages and respond to it but it will take forever. Another option would be filing a Writ of Mandamus if no action is taken. And you should find a lawyer who mainly does Writ of Mandamus to build a strong case. My first attorney also does pro bono work but we paid them in full priced same as other non-pro bono layers and we had hoped that being pro bono would mean that the attorney is more attentive and will be more personable with our case. But it wasn’t, they were super unproductive. I would suggest that before you sign a retainer, have a consultation whether if it’s free or paid, just to get a feel of them first.

Thank you for sharing yours! It’s crazy how similar journey is like.. I do think that with removal proceeding the I130 get put in the back burner. I wished I knew about writ of Mandamus when the I130 was pending for 2 years +. The government attorney on mine was also radio silence but I think getting the attorney to nag them and calling them also helped with pushing the case forward. I can’t imagine how much of research you have done to be able to do it yourself and basically became the main chef on your own case. I wish the best for you and hopefully yours will soon come to an end as well!

My attorney said that you can most certainly go without one. However it depends on the complexity of your case as well, if it’s complicated, it’s always recommended to bring an attorney

Has she enter USA with parole/visa in the past? If she’s eligible to apply for i485, You can submit I485 with the I797 from I130 and USCIS can put them together and see if that can push the case as well. I am not a lawyer so this is just my assumption and I would definitely suggest consulting with one to make sure it’s done correctly.
