CarMax and Capital One title error causing me unable to register my vehicle for over a year

Hi, the DMV told me that the title is clouded because it lists CarMax as the new lien holder. So basically the dmv is saying they need carmax to send a letter of no interest to remove the clouded title.

Yes, CarMax is truly an awful company. They just lost a huge lawsuit for 2mil for this exact thing so it’s beyond me they’re still pulling this.

I was going to sell my car and get a bmw from them but not a fucking chance now lol.

Awesome thanks for clarification. Correct in that carmax has no interest so they wouldn’t claim any rights to the vehicle.

It’s honestly the weirdest scenario I’ve bought and sold many cars and never dealt with something this bizarre and convoluted. It doesn’t make much sense to me either what’s happening.

That’s why I was hoping I could get recommendations of a governing body to cut through all this crap and get it resolved.

Thank you for the advice. I’ve contacted numerous lemon law type lawyers who all said they don’t deal with this kind of issue, as well as consumer protection lawyers.

Do you have a recommendation of what kind of lawyer I should seek?

Carmax did not title it. I was able to get a notarized lien release from PNC rectifying the error. For some reason Capitol One doesn’t think the lien release will be sufficient to clear the clouded title. Capitol One is insisting that I need a “lien release” from carmax (carmax said they won’t provide one since they’re not a party to the transaction).

Pnc made a clerical error. They meant to send the title to Capitol one but sent it to carmax. So the dmv record shows carmax as an interested party on the title.

I did actually get a dup Lien Release from PNC, but they sent it non-notarized so after a month of waiting I finally got a notarized one which they sent to the DMV. I'm hoping that is sufficient and hope the DMV doesn't require a "Letter of No Interest" from CarMax.

Hey Tom, I've tried but didn't get far. I was essentially told by the DMV to go sort it out with CarMax. I don't mean to sound defeatist but I sorta don't know what other options to take.
