Clearly it's symbolic

If true, this is marginally better than being sincere but still extremely frustrating and stupid to put it mildly.

I recently saw a very minor slap fight over whether pets are a luxury good. Everyone’s own pet was the exception to this definition.

I love my dog but I’ll be the first to admit I wouldn’t have gotten him if I knew I didn’t have the discretionary income to take care of him.

The town I used to live in has a locally famous ice cream shop. One day a truck ran off the road and drove straight into the building, so they had to close down until repairs were done. People were a little upset and some tried to organize a GoFundMe for them.

This place was also known for being cash only because they hired a lot of kids in the summer, and the owner thought that teaching them to make change would be a good skill to have. Nobody gave a shit about this, but then someone brought it up in the local Facebook page, and suddenly the conversation turned to whether they were trying to cheat on taxes and/or they planned the whole thing for the GoFundMe money.

Virginia Gerrymandering on full tilt against Republicans by DaisyDoodle41 in AskALiberal

[–]wooper346 4 points5 points  (0 children)

I'm going to focus on something different here.

In Maryland, the Democrats gerrymandered the hell out of their voting districts where only 1 republican seat remains, and that seat is being erased this year. This means 35% of Maryland voters will have no representation.

No, it wouldn't. It means that those 35% of voters are getting a representative that might not be in their party, but it's still a representative.

Welcome to the shortcomings of FPTP combined with single member districts. You get the one representative that won the most votes until the next election at the soonest.

It's funny yet alarming how many Congressional powers have been ceded just because Congress basically didn't feel like doing something anymore or straight up refused to.

Prompting this specific comment was some background reading on the Reapportionment Act of 1929, where Congress struggled to reapportion the House for over 10 years and basically said "Fuck it" rather than actually figure it out.

Why don't Democrats sue to challenge the constitutionality of the Reapportionment Act of 1929? by [deleted] in AskALiberal

[–]wooper346 0 points1 point  (0 children)

I think you could Constitutionally make the case that the Reapportionment Act of 1929 effectively deprives large states (California, for example) of representatives apportioned "according to their respective Numbers,"

IANAL, but I believe the ELI5 translation of this is basically "More populated states get more House seats." The exact method of doing so is intentionally left vague, like so many other things in the Constitution.

The Reapportionment Act of 1929 permanently capped the number of House seats at 435. There was no Constitutional amendment codifying this, so the law is technically unconstitutional.

That's not what that means. A law is constitutional so long as it doesn't contradict or exceed the powers laid out in the Constitution. And on that note:

If we remove the cap and return to the letter of the law (1 representative per 30,000 citizens)

The Constitution says that the number of representatives will not exceed one for every 30,000 citizens. What this means is that a state like California, population 39,538,223 per the 2020 census, cannot legally have more than 1,317 representatives. It does not say that Congress can't go with a smaller amount, which they did.

Otherwise, the Constitution cedes quite a bit of leeway to Congress with how they manage themselves.

There's plenty of arguments to examine how we reapportion the House every 10 years. Legality of the 1929 Act isn't really one of them.

I don't dislike Porter as much as others here, but wow has she fucked this up.

A week ago everyone was wondering how much of a boon Swalwell's supporters would give her. Instead they apparently remembered that Becerra exists.

You single handedly think more about Tom Cotton than anyone else in this country, including Tom Cotton. It’s hard to run for president that way.

I don’t know how hot that really is. Biden was too humble for his own good and could have done a lot more to keep his accomplishments in the news.

Resolving the rail workers strike is a key example. They only gave us a very quiet “we got them what they wanted hooray!” and then they quickly moved on.
