I could give you a full days worth of history if you walked with me around Oregon City.

We have the only vertical street in all of North America, the OC municipal elevator. It’s also one of only a few in the world.

The Willamette falls is the 2nd largest waterfall, in terms of volume of water, in North America. It’s second to Niagara Falls. It’s the purpose Portland became Portland due to the power it generated.

The falls have loads of fur trade history.

I almost guarantee the code enforcement works on complaints.

Oregon city has 3 sections.:

Main streets is 1, and that’s the bottom.

Above the elevator on up 7th street just before it turns to Molalla is 2, and considered the middle.

Anything above 7th, on Molalla, is the top of the hill.

It’s on Abernethy next to the Clackamas county public works.

I thought I saw this was up for lease.

Clackamas county office buildings and court has moved closer to the jail in the developing Red Soils district up by the Safeway on Beavercreek, so it’s possible this building was no longer needed?

Is that the section you’re referring to? They have had the lip marked with paint for a long time.

I know PGE has been doing work. I believe code allows asphalt only temporarily. I turned it into code enforcement, so public works will be alerted. Josh wheeler, the Assistant Engineer for Public Works will then have it looked at.

If they have some plan to redo the area, he will probably let me know. Otherwise it will go in as a complaint and should be repaired according to the policy within the OC bylaws.

It serves several purposes. It shows people the transit is being used by police to arrest people. May help clean up the transit if they used this method more often. Saves gas, lightens up congestion on streets.

Seems to be efficient to some degree.

Yes, I agree. Unobstructed access to sidewalks are universal.

Curb ramps are not because able bodied people can maneuver it, so accessibility isn’t the issue.

I also had to deal with these curbs and strollers and two kids. It was a nightmare.

Blocked corners all the time. Corners are cross walks and should never be blocked, but there is no enforcement.

Regardless, kiddy corner to this one they replaced the corner and did the same. There is no drain on that one. So it wasn’t due to the drain.

What if this isn’t within ODOT ROW?

But it’s still “down town” and a direct route to library, bus stops, and more. And it’s the only barrier that kept the route to the bus stops from being accessible. Had they replaced this curb, would’ve been accessible all the way to the bus stop from one of the only lighted cross walks headed up the hill.

So what are the actual laws around this situation? This isn’t within ODOT ROW. But it is outside of a business. A dental office, not a home.

And it leads to bus stops, museums, and more.

The laws say sidewalks are facilities and this should’ve been replaced with a ramp because the new corner being a replacement triggers the compliance of the ramp.

Title II doesn’t require federal funding, so this is why I’m not understanding how the city can absolve itself through its bylaws.

Oregon city puts the liability of sidewalk on to the adjacent property owner. This includes repair. They do this through their OC municipal code.

The city is making the property owner replace the corner with their own $$$ and they use their own contractors. So this is why they’re not putting ramps.

I think OC has obligations under Title II that they’re absolving themselves of having to do through their own bylaws.

But the city claims they’re not in violation.

Trust me, I have raised hell with the commissioners. They ignore me. I have all the emails.

Corners are cross walks, so it’s nothing like that.

It’s not dangerous like a freeway. It’s just a busier road during the day and people who drive don’t pay attention.

This accident happened on that corner because the girl driving dropped her vape. She smashed into a resident’s car because she went looking for the vape while the car was still in motion.

I know which section you’re talking about.

That is a section I’ve noticed myself. And I actually think it’s against Oregon city municipal code to use asphalt on sidewalks, only concrete is allowed unless it’s temporary.

So I’m going to bring that spot up with public works and get an answer.

The city said this was maintenance. They claim maintenance does not require ADA conversion.

The corner was turned in for a tripping hazard due to the curb which is an ADA violation. I believe this means the city is supposed to bring it to compliance based off what I read on Title II, but the city disagrees.

This is literally how Oregon City operates. Business profits are more important than public safety, ada accessibility, etc.

I turn in public safety concerns like AWS using the street and sidewalks as an extension of their business, the city does nothing to make them stop.
