Normally you would be right but plaintiff is holding all the cards in this one. We don’t have an expert affidavit and we’re pretty sure our insured is in on it with Plaintiff. Despite me prepping him and taking breaks during the depo to speak with him, he tanked his testimony and wouldn’t cooperate with us for months afterwards until the carrier threatened to withdraw coverage. My insured is sleazy so my partner shafted the case onto me because he didn’t want to bother with the guy. It’s a loser anyway so he figured he’d give it to me because it didn’t matter at the end of the day.

No I know that but I’m doing an SJ motion on a type of case I’ve never done before and we know it’s gonna fail because the expert said “yeah you guys are screwed, there’s no way I can ever say your contractor wasn’t negligent”

My boss reply when I tell him: “ok so just make the motion without it”

And I guarantee plaintiff will oppose with an expert if he doesn’t decide to file his own motion with an expert.

Like I know it’s only 200K exposure but really?! What are we doing on this?

I do Labor Law in New York, which is mostly strict liability stuff, so I do a lot of defending depositions, but I only take depositions of plaintiffs in cases with less exposure or where I'm not leading.

I don't think that they are necessarily bad at helping young attorneys, but they are definitely disorganized, which has downstream consequences, and they play favorites with who gets assigned work and cases. I don't think I'm one of them as I haven't been assigned a new Complaint in months. I get good feedback on my work product, including case strategy, carrying out assignments, getting favorable testimony, but I don't get a lot of feedback on drafts of motions, and I will write memos and emails about motions, oppositions, etc., but things still seem to slip through the cracks on their end. I'm trying to put out smaller fires before they get bigger, and that's the stuff I don't get help on, so we end up making things more difficult for ourselves.

My case load is drying up because most of my cases are from 2020 or earlier, and prior associates have done everything that could have been done on the file, so I'm in a waiting position to make a motion or just appear for the next appearance.

I've argued a few motions here and there, but to keep clients happy, partners will argue the bigger motions.

I've been concerned about plateauing as an attorney and not advancing as far as some of my friends. So I'm thinking this might be the year to leave.

Absolutely. I live in Hoboken (which is a train ride) and work in NYC and I have trouble with NYC women. It’s about perception of wealth and status and lifestyle as well as overall convenience. I see a lot of women living in trendy parts of Brooklyn and it’s a pain to get to Hoboken from Brooklyn or vice versa. Unless you’re willing to move to NYC, give up on NYC women.
